At Paragraphs 34-35 of the Complaint, the plaintiff, Rose Altman, alleges as follows: 34. On or about September 24, 2012, plaintiff was lawfully, carefully and properly walking over and along the Accident Location when, owing to the negligence of the defendants, in failing to maintain and keep the Accident Location in a safe and proper condition and in permitting it to become and remain dangerous and unsafe, plaintiff suddently and without any notice or warning to her, was caused to slip, trip and fall violently to the ground. 35, The occurrence was caused solely by the negligence, carelessnes and recklessness of the defendants and their respective agents, servants, employees, licensees and/or independent contractors, without any negligence on the part of the plaintiff contributing thereto.November 24, 2015 Rosenbaum & Rosenbaum, P.C.
