I am a partner with the law firm of GORDON & REES SCULLY MANSUKHANI, LLP, attorneys for Defendant EMORAL INC. f/k/a POLAROME INTERNATIONAL, INC (hereinafter “Emoral”). As such, I am fully familiar with the facts and circumstances surrounding this matter. 2. I respectfully submit this Affirmation in reply and in further support of Emoral’s motion to dismiss Plaintiffs’ Complaint pursuant to CPLR §327(a) on the basis of forum non conveniens. 3. For the reasons set forth more fully in the accompanying Reply Memorandum of law, Plaintiffs’ opposition is devoid of any basis which would support denial of Emoral’s motion. Indeed, this case is wholly devoid of any nexus to New York. WHEREFORE, Defendant EMORAL, INC. f/k/a POLAROME INTERNATIONAL, INC. respectfully requests that this Honorable Court grant the instant motion in its entirety and enter an Order pursuant to CPLR § 327(a) dismissing Plaintiffs’ Complaint and all claims against Emoral on the basis of forum non conveniens, together with such other and further relief as this Honorable Court deems just, proper and equitable.
