JOINT MOTION TO STAY PENDING SETTLEMENT NEGOTIATIONS on™ we | The parties hereby jointly move that the Court stay the proceedings in the above- Ge | nor =*N gBfionea case for fourteen (14) days until Wednesday, June 12, 2024. The parties have agreed to eg conduct settlement negotiations with the goal of resolving this matter. Good cause exists to stay of the proceedings, including the upcoming hearing on the motion for preliminary injunction, as . \ outlined immediately below: This is case brought by Patient Centric,of Martha’s Vineyard, Ltd., d/b/a Island Times (“Patient Centric”), and The Green Lady Dispensary, Inc. (“Green Lady”) (together, “Plaintiffs”), against the Cannabis Control Commission (“Commission”) for declaratory and injunctive relief in connection with the Commission policy of prohibiting Plaintiffs and other island-based cannabis establishments from transferring cannabis and cannabis products to and from other licensed cannabis business in Massachusetts over state territorial waters. See Docket Number (“Dkt. No.”) 1. On May, 21, 2024, Plaintiffs filed the operative verified complaint. Dkt. No. 1. On that he same day, Patient Centric filed an emergency motion for preliminary injunction and supporting memorandum of law. Dkt. Nos. 3 & 4. The Court (Salinger, J.) ordered that the Defendant file any opposition to the emergency motion for preliminary injunction by 12 PM on Friday, May 31, 2024, and scheduled a hearing on the emergency motion for preliminary injunction for Thursday, June 6, 2024. On May 30, 2024,.the Commission authorized its General Counsel to enter into settlement discussions with Plaintiffs. : The parties have determined that it is in their mutual interest to attempt to resolve this matter through negotiations and that staying the proceedings will enable them to have the time needed to review and discuss the complex issues in this case. The parties will work in good faith to resolve this matter by June 7, 2024. In light of these considerations, the parties respectfully request that the court stay the proceedings for fourteen (14) days, This would include staying Defendant’s obligation to respond to Patient Centric’s emergency motion for preliminary injunction and cancelling the upcoming hearing on the motion.
