(“KIC”), hereby moves that the Court issue a Summons and Short Order of Notice that the Defendant answer the Complaint and appear for a hearing on the Plaintiff's Motion for Preliminary Injunction at the Court’s earliest convenience. In support of this Motion, the Plaintiff contends that it is seeking a Preliminary Injunction to preserve the status quo and restrain the Defendant, Principal Freight and Logistics, LLC (“Principal Freight”), from disposing, alienating, damaging, encumbering or selling the following motor vehicle, which is secured collateral under a Note pursuant to a financing statement under the Massachusetts Uniform Commercial Code which names Principal Freight as the debtor and KIC as the secured party: a white 2020 Kenworth T680 (VIN: IXKYD49X8LJ343785) (the “truck”). See Exhibit 3 to Complaint. KIC contends that such an order is necessary to safeguard and immediately protect its interest in the truck and prevent any potential destruction, vandalism, and wear and tear to said vehicle pending the outcome of this lawsuit.
