NO. 9 RECEIVED NYSCEF: 06/20/2024 2024, at approximately 1848 hours, I, POMichael Hanley, of the Nassau County On May 13, Police Department, 8th marked RMP was assigned to 8th Precinct Patrol. At approximately 1848 hours, I, PO Precinct, serial #10337, in 811, Hanley, responded to a radio assignment of an auto accident on North Jerusalem Road and Mayer Drive, Levittown, I observed two vehicle with damageto them. I, .County of Nassau, New York. As I, PO Hanley, approached the scene, POHanley, observed a 2006 Green Hyundai Tuscon bearing NYRegistration KWX2278parked on the right shoulder of North Jerusalem Road facing east bound, with the front end of vehicle extending into the roadway. Upon further it was observed that there was passenger side damageto the Tuscon. Further more I, PO Hanley investigation observed a 2022 white Dodge Rambearing NewYork Registration CLNCRUZN with a trailer in tow bearing New York Registration CD85433 parked on the right shoulder of North Jerusalem Road. Upon further investigation it was observed there was damage to the Dodge Ramdriver side and trailer in tow. I POHanley, at the scene determined that an auto collision did occur between two vehicles and During the investigation, there was no injuries reported. I, POHanley determined that the 2006 Green Hyundai Tuscon bearing NYregistration KWX2278was operated by defendant Parra. Furthermore I, POHanley determined that the 2022 Dodge Ramwas operated by involved other Silverman with involved other Abreuadames in front passenger seat. While conducting an investigation 1, PO Hanley, observed defendant Parra to be seated on the grass in front of 3140 North Jerusalem Ave, Levittown. During my interview with defendant Parra, I POHanley was handed defendant New York State identification by PO Lomonaco, which defendant was then positively identified as Parra, Fernando (DOB: 05/30/1959). I observed him to have an odor of an alcoholic beverage on his breath, slurred speech, and also soiled himself. I also observed the defendant to have glassy and watery eyes. I asked defendant Parra, if he had been driving "Yeah." today, to which he replied in sum, A show up was conducted by Involved others Silverman and Abreadames who both positively identified defendant Parra as the operator of the 2006 Hyundai Tuscon bearing NYregistration KWX2278. I, POHanley, administered Standard Field Sobriety Tests to determine if there was impairment. Due to a language and translation. I administered the test to barrier, Assisting Officer Serrano serial #9349 responded to scene to assist defendant in front of 3140 North Jerusalem Ave, Levittown, on the sidewalk. The test was administered with positive results. At approximately 1940 hours, I POHanley administered a PBTto defendant Parra, positive results .236% BAC (PBT#261095). Based on my observations and the results of SFST's, I, POHanley, then placed defendant Parra under arrest at approximately 1942 hours for driving while intoxicated. Defendant Parra was transported to Nassau County Central Testing for arrest processing with POLomonaco in marked RMP801. At approximately 2112 hours, Breath Tech POKomarnicki Serial 9053 administered a chemical breath test of Defendants breath with a result of.23% BAC. Miranda was ead to Defendant 2112hrs Defendant did waive Miranda rights to Breath Tech PO Komamicki. Upon an E-justice inquiry, it was determined that defendant had a previous DWI conviction within 10 years, 08/06/2015. Defendant is charged with NewYork State VTL's 1192.1 1192.2AA, 1192.01, 509.1 and1192.03. Defendant's vehicle was impounded to AAAA-1 towing at 34 Charlotte Ave, Hicksville, NewYork.
