WHEREAS a hearing was held before the Honorable Hal B. Greenwald on July 6, 2023
regarding Plaintiff’s counsel’s motion seeking permission to withdraw as counsel (NYSCEF Doc.
No. 199, hereinafter “Hearing Transcript”);
WHEREAS Steven M. Brunnlehrman, Esq., of counsel to Plaintiff’s attorneys, Rosman
Legal, P.C., notified the Court that he would be out of state to take his son to his freshman dorm
for a number of days mid-August;
WHEREAS a briefing schedule was established during the aforementioned hearing for
opposition papers, cross-motion, and reply papers , under which any opposition and cross-motion
would be due on August 10, 2023, any reply in further support of the motion to withdraw and
opposition to any cross-motion would be due on September 18, 2023, and any reply in further
support of any cross-motion would be due on October 6, 2023;
WHEREAS, on August 10, 2023, Defendant filed an opposition to the motion to withdraw
and a cross-motion for summary judgment and an award of attorney’s fees and costs under Part
130 and CPLR 8303-a (see NYSCEF Doc. No. 169);
WHEREAS the Court had indicated that “10/6 is the forecasted date for being fully
submitted.” Hearing Transcript p. 10 lines 4-5 (emphasis added);
WHEREAS Mr. Brunnlehrman, of counsel to Rosman Legal, P.C., is now unexpectedly

being called away during the week of Monday, September 11, 2023, to visit his 99 year-old father-
in-law, who resides in Florida, for the Jewish New Year;
WHEREAS Defendant’s attorneys expressed their amenability to adjourn briefing dates
for Plaintiff’s opposition and Defendants’ reply;
IT IS HEREBY STIPULATED AND AGREED, subject to approval by the Court, that
the deadlines set down at the July 6, 2023 hearing are extended as follows:
1. The deadline for Plaintiff’s opposition to Defendant’s cross-motion is extended to
September 25, 2023.
2. The deadline for Defendant’s reply to Plaintiff’s opposition is extended to October
13, 2023.
3. Motion Sequence Nos. 8 and 9 are to be deemed fully submitted on October 13,
2023.
4. The Parties respectfully request that the conference currently scheduled for October
17, 2023 at 2:00 PM, for rendering of the Court’s decision, remain as scheduled, if
convenient for the Court.
