       Eleanor Brandt, being first duly sworn on oath, deposes and states as follows:

               1. I am the penalty administrator for the Minnesota Department of Labor and Industry,
       Occupational Health and Safety Division, and a custodian of the records of the Department, and I have
       firsthand knowledge of the above captioned matter.
               2. Pursuant to a October 31, 2023, Citation and Notification of Penalty, the Defendant was ordered
       to pay the Department a penalty in the amount of $3750.00. The Citation and Notification of Penalty is now
       a final order of the Commissioner that is not subject to review by any court or agency. A certified copy of
       the Citation and Notification of Penalty is attached hereto and incorporated herein as Exhibit 1.
               3. This Affidavit is made in support of the Department’s request to have the unpaid portion of the
       penalty entered and enforced as a judgment pursuant to Minnesota Statute § 16D.17.
               4. The records of the Department show that it has not received any payment toward the penalty
       amount due.
               5. Pursuant to Minn. Stat. § 182.666, subd. 7, unpaid fines shall be increased to 125 percent of the
       original assessed amount if not paid within 60 days after the penalty becomes a final order and 10 percent
       each month thereafter. The records of the Department show that as of June 6, 2024, the unpaid portion of the
       penalty due is $5,156.25.
