GREETINGS:
WHEREAS the Summons and Complaint of Plaintiff NEIL B. RICE (“Plaintiff”), having
been filed with this Court on August 25, 2021, seeking damages sounding in tort against Defendant
LEE R. EINSIDLER (“Defendant”) as Administrator of the Estate of Aaron Michael Einsidler
(“Deceased”);
WHEREAS Plaintiff’s claims against Defendant having involved certain alleged actions
taken by the Deceased;
WHEREAS Plaintiff having stated that he observed a specific tattoo on the Deceased’s
body not normally exposed to the public;
WHEREAS the narrative provided on the attached, redacted Autopsy Report M2020-2485
of Aaron M. Einsidler, the Deceased, references “numerous professionally done tattoos which are
photographed”;
WHEREAS Plaintiff has stated that he observed that the Deceased had two "heart-shaped"
tattoos located on Decedent's pubic area just above Decedent's genitalia;
NOW, on motion of ROSMAN LEGAL, P.C., attorneys for Plaintiff, it is
ORDERED that within thirty (30) days of the presentation of a certified copy of this Order,
the Office of the Medical Examine shall provide reproductions of any and all photographs that
appear to capture the described “heart-shaped” tattoo(s) located within Deceased’s pubic area; and
ORDERED that, to the extent the Deceased’s genitals are visible in any such
photograph(s), the custodian of the autopsy record shall redact any view of the Deceased’s genitals
to the maximum extent possible without redacting any tattoo(s) in the region; and
ORDERED that the custodian of the autopsy record shall not release any photographs
showing regions of Aaron’s body other than the pubic area above or around the genitals;
ORDERED that, to the extent any photograph(s) showing the Deceased’s pubic area above
his genitals also show other portions of his body, the custodian of the autopsy record shall redact
such photograph(s) to limit disclosure to the pubic area above or around the genitals; and
ORDERED that if no such photograph(s) exist, the custodian of the autopsy record shall
so state in an Affidavit provided to Plaintiff’s counsel, and shall not release or permit Plaintiff, his
counsel, or other agents to inspect any other part of the autopsy file; and
ORDERED that within five (5) days of receiving said photographs or Affidavit, or any
correspondence relating thereto, Plaintiff’s attorneys shall provide Defendant’s attorneys with
copies of such photographs, Affidavit, or correspondence.

Einsidler, the Deceased, references “numerous professionally done tattoos which are photographed”; WHEREAS Plaintiff has stated that he observed that the Deceased had two "heart-shaped" tattoos located on Decedent's pubic area just above Decedent's genitalia; NOW, on motion of ROSMAN LEGAL, P.C., attorneys for Plaintiff, it is ORDERED that within thirty (30) days of the presentation of a certified copy of this Order, the Office of the Medical Examine shall provide reproductions of any and all photographs that appear to capture the described “heart-shaped” tattoo(s) located within Deceased’s pubic area; and ORDERED that, to the extent the Deceased’s genitals are visible in any such photograph(s), the custodian of the autopsy record shall redact any view of the Deceased’s genitals to the maximum extent possible without redacting any tattoo(s) in the region; and ORDERED that the custodian of the autopsy record shall not release any photographs showing regions of Aaron’s body other than the pubic area above or around the genitals; ORDERED that, to the extent any photograph(s) showing the Deceased’s pubic area above his genitals also show other portions of his body, the custodian of the autopsy record shall redact such photograph(s) to limit disclosure to the pubic area above or around the genitals; and ORDERED that if no such photograph(s) exist, the custodian of the autopsy record shall so state in an Affidavit provided to Plaintiff’s counsel, and shall not release or permit Plaintiff, his counsel, or other agents to inspect any other part of the autopsy file; and ORDERED that within five (5) days of receiving said photographs or Affidavit, or any correspondence relating thereto, Plaintiff’s attorneys shall provide Defendant’s attorneys with copies of such photographs, Affidavit, or correspondence.
