I will address each of your requests individually. 1. All records of communications exchanged between any individual associated with or employed by the West Virginia Office of Disciplinary Counsel and any entity, individual or third- party not associated with the West Virginia Office of Disciplinary Counsel concerning or relating to Anthony Zappin. The ODC is a prosecutorial agency and entitled to the protections of the attorney/client and work product privileges. West Virginia’s FOIA statute incorporates those protections.1 Communications with third-parties relative to your disciplinary proceedings may not implicate the attorney/client privilege, but they do implicate the fact and opinion work product doctrines. For this reason, “a prosecutor's entire work product is privileged from disclosure under the FOIA.”2 Additionally, the West Virginia Freedom of Information Act expressly exempts, “Information specifically exempted from disclosure by statute,”3 and Rule 2.6 of the Rules of Lawyer 1 See Highland Min. Va. Code §§ 29B-1-4(4), (5), and (8) as interpreted and applied by the Supreme Court of Appeals of West Virginia. 2. This includes any records showing browser histories of such searches. The same analysis applies to this request, and underscores the applicability of the work product doctrine. 10. All non-privileged and non-exempt records in the possession, custody or control of Chief Disciplinary Counsel Rachael Fletcher Cipoletti and/or the Office of Disciplinary Counsel concerning or pertaining to Anthony Zappin or the investigation into his alleged attorney misconduct, which were otherwise not filed with the Hearing Panel Subcommittee or the West Virginia Supreme Court of Appeals in the WVReciprocal Disciplinary Action. There are no “non-privileged and non-exempt records in the possession, custody or control” of the ODC pertaining to your disciplinary proceedings or the related investigation. Again, this request goes to the heart of the work product doctrine. Va. Code § 29B-1-3(3) (emphasis supplied). This limited production requirement is reinforced as follows: “The custodian, upon demand for records made under this statute, shall as soon as is practicable but within a maximum of five days not including Saturdays, Sundays, or legal holidays: (a) Furnish copies of the requested information; (b) Advise the person making the request of the time and place at which he or she may inspect and copy the materials; or (c) Deny the request stating in writing the reasons for such denial.” W. Va. Code § 29B-1-3(4) (emphasis supplied).
