The information on the back of this form is provided pursuant to Family Code 3044(h)
What does this mean to parties involved in a custody/visitation hearing?
Ordinarily, the law prefers joint custody. However, if there is a finding that there
has been domestic violence, the party who committed domestic violence cannot
be given joint custody unless the judge finds there are really compelling facts that
would justify ordering joint custody.
CALIFORNIA FAMILY CODE 3044
(a) Upon a finding by the court that a party seeking custody of a child has perpetrated domestic violence within
the previous five years against the other party seeking custody of the child, or against the child or the child's siblings, or
against any person in subparagraph (C) of paragraph (1) of subdivision (b) of Section 3011 with whom the party has a
relationship, there is a rebuttable presumption that an award of sole or joint physical or legal custody of a child to a
person who has perpetrated domestic violence is detrimental to the best interests of the child, pursuant to Sections
3011 and 3020. This presumption may only be rebutted by a preponderance of the evidence.
(b) To overcome the presumption set forth in subdivision (a), the court shall find that paragraph (1) is satisfied
and shall find that the factors in paragraph (2), on balance, support the legislative findings in Section 3020.
(1) The perpetrator of domestic violence has demonstrated that giving sole or joint physical or legal custody of a
child to the perpetrator is in the best interests of the child pursuantto Sections 3011 and 3020. In determining the best
interests of the child, the preference for frequent and continuing contact with both parents, as set forth in subdivision (b)
of Section 3020, or with the noncustodial parent, as set forth in paragraph (1) of subdivision (a) of Section 3040, may
not be used to rebut the presumption, in whole or in part.
(2) Additional factors:
(A) The perpetrator has successfully completed a batterer’s treatment program that meets the criteria outlined
in subdivision (c) of Section 1203.097 of the Penal Code.
(B) The perpetrator has successfully completed a program of alcohol or drug abuse counseling, if the court
determines that counseling is appropriate.
(C) The perpetrator has successfully completed a parenting class, if the court determines the class to be
appropriate.
(D) The perpetrator is on probation or parole, and he or she has or has not complied with the terms and
conditions of probation or parole.
(E) The perpetrator is restrained by a protective order or restraining order, and he or she has or has not
complied with its terms and conditions.
(F) The perpetrator of domestic violence has committed any further acts of domestic violence.
(c) For purposes of this section, a person has “perpetrated domestic violence” when he or she is found by the
courtto have intentionally or recklessly caused or attempted to cause bodily injury, or sexual assault, orto have placed
a person in reasonable apprehension of imminent serious bodily injury to that person or to another, orto have engaged
in behavior involving, but not limited to, threatening, striking, harassing, destroying personal property, or disturbing the
peace of another, for which a court may issue an ex parte order pursuant to Section 6320 to protect the other party
seeking custody of the child or to protect the child and the child’s siblings.
(d) (1) For purposes of this section, the requirement of a finding by the court shall be satisfied by, among other
things, and not limited to, evidence that a party seeking custody has been convicted within the previous five years, after
a trial or a plea of guilty or no contest, of a crime against the other party that comes within the definition of domestic
violence contained in Section 6211 and of abuse contained in Section 6203, including, but not limited to, a crime
described in subdivision (e) of Section 243 of, or Section 261, 262, 273.5, 422, or 646.9 of, the Penal Code.
(2) The requirement of a finding by the court shall also be satisfied if a court, whether
that court hears or has heard the
child custody proceedings or not, has made a finding pursuantto subdivision (a) based on conduct occurring within the
previous five years.
(e) When a court makes a finding that a party has perpetrated domestic violence, the court may not base its
findings solely on conclusions reached by a child custody evaluator or on the recommendation of the Family Court
Services staff, but shall consider any relevant, admissible evidence submitted by the parties.
(f) (1) It is the intent
of the Legislature that this subdivision be interpreted consistently with the decision in J aime
G.v.H.L.(2018)____ Cal.App.5th _ _, which requires that the court, in determining that the presumption in
subdivision (a) has been overcome, make specific findings on each of the factors in subdivision (b).
(2) If the court determines that the presumption in subdivision (a) has been overcome, the court shall state its reasons
in writing or on the record as to why paragraph (1) of subdivision (b) is satisfied and why the factors in paragraph (2) of
subdivision (b), on balance, support the legislative findings in Section 3020.
(g) In an evidentiary hearing or trial in which custody orders are sought and where there has been an allegation
of domestic violence, the court shall make a determination as to whether this section applies priorto issuing a custody
order, unless the court finds that a continuance is necessary to determine whether this section applies, in which case
the court may issue a temporary custody order for a reasonable period of time, provided the order complies with Section
3011, including, but not limited to, subdivision (e), and Section 3020.
(h) In a custody or restraining order proceeding in which a party has alleged that the other party has perpetrated
domestic violence in accordance with the terms of this section, the court shall inform the parties of the existence of this
section and shall give them a copy of this section priorto any custody mediation in the case. Effective J anuary 1, 2019

éQue significa esto para las partes involucradas en una audiencia de custodia/visitaci6n?
Normalmente, la ley prefiere la custodia conjunta. Sin embargo, si se llega a la conclusién de que ha habido
violencia doméstica, a la parte que cometié violencia doméstica no se le puede otorgar la custodia
compartida a menos que el juez determine que existen hechos realmente convincentes que justificarian la
ordenacidn de la custodia compartida.
3044-C opiGo LEY DE FAMILIA DE CALIFORNIA
(a) Cuando el tribunal determina que una parte que solicita la custodia de un menor ha perpetrado violencia
doméstica en los Ultimos cinco afios contra la otra parte que solicita la custodia del menor, o contra el menoro los hermanos
del menor, o contra cualquier persona en el subparrafo (C) del parrafo (1) de la subdivision (b) de la Seccién 3011 con la que
la parte tiene una relacién, existe una presuncidn refutable de que la adjudicacién de la custodia fisica 0 legal unica o
conjunta de un nifio a una persona que ha perpetrado la violencia doméstica es perjudicial para el interés superior del nifto,
de conformidad con las Secciones 3011 y 3020. Esta presuncién solo puede ser refutada por una preponderancia de la
evidencia.
(b) Para superarla presuncidn establecida en la subdivision (a), el tribunal debe determinar
que el parrafo (1) esta
satisfecho y los factores en el parrafo (2), en general, respaldan los hallazgos legislativos en la Seccidn 3020. (1) El
perpetrador de violencia doméstica ha demostrado que otorgar la custodia fisica o legal Unica o conjunta de un nifo al
perpetrador es lo mejor para el nifio conforme a las Secciones 3011 y 3020. Al determinarel interés superiorel nifio, La
preferencia por el contacto frecuente y continuo con ambos padres, segtin lo establecido en la subdivision (b) de la Seccion
3020, 0 con el padre sin custodia, segtin lo establecido en el parrafo (1) de la subdivision (a) de la Seccién 3040, no se puede
utilizar para Refutarla presuncion, en su totalidad o en parte. (2) Factores adicionales: (A) El autor ha completado con éxito
un programa de tratamiento para el agresor que cumple con los criterios descritos en la subdivision (c) de la Seccién
1203.097 del Cddigo Penal. (B) El perpetrador ha completado con éxito un programa de asesoria sobre abuso de alcohol o
drogas, si el tribunal determina que la asesoria es apropiada. (C) El autor ha completado con éxito una clase de crianza de
los hijos, si el tribunal determina que la clase es apropiada.(D) E! autor esta en libertad condicional o bajo palabra, y él o ella
ha cumplido o no con los términos y condiciones de la libertad condicional 0 bajo palabra. (E) El autor esta restringido por una
orden de proteccién u orden de restricci6n, y él 0 ella ha cumplido o no con sus términos y condiciones. (F) El perpetrador de
violencia doméstica ha cometido cualquier otro acto de violencia doméstica.
(c) Para los fines de esta secci6n, una persona ha "perpetrado violencia doméstica" cuando el tribunal determina que
él ella ha causado intencionalmente o imprudentemente o ha intentado causar lesiones corporales, agresién sexual, o
haber colocado a una persona en la aprehensidn razonable de dafio corporal grave e inminente a esa persona 0 a otra
persona, o de haber participado en una conducta que involucre, pero no se limita a, amenazas, huelgas, hostigamiento,
destruccién de propiedad personal o perturbacion de la paz de otra persona, por la cual un tribunal puede emitir una orden ex
parte de conformidad con la Seccién 6320 para proteger a la otra parte que busca la custodia del nifio o para proteger al nifio
y sus hermanos.
(d) (1) Para los fines de esta seccién, el requisito de un fallo por parte del tribunal se debe cumplir, entre otras cosas,
y no se limita a las pruebas de que una parte que solicita la custodia ha sido condenada dentro de los cinco afos anteriores,
después de un juicio o declaracién de culpabilidad o no impugnacion, de un delito contra la otra parte que se incluye en la
definicién de violencia doméstica contenida en la Seccién 6211 y de abuso contenido en la Seccién 6203, que incluye, entre
otros, un delito descrito en la subdivision (e) de la Seccién 243 de, o la Seccién 261, 262, 273.5, 422, 0 646.9 del Cddigo
Penal. (2) El requisito de un fallo por parte del tribunal también se cumplira si un tribunal, ya sea que el tribunal oiga o haya
escuchado los procedimientos de custodia del menor 0 no, haya realizado un fallo de conformidad con la subdivision (a)
basada en una conducta que se produjo dentro de la decision anterior. cinco aftos.
(e) Cuando un tribunal determina que una parte ha perpetrado violencia doméstica, el tribunal no puede basar sus
hallazgos Unicamente en las conclusiones alcanzadas por un evaluador de la custodia de los hijos o en la recomendacién del
personal de los Servicios de la Corte Familiar, pero considerara cualquier informaci6n relevante. Pruebas admisibles
presentadas por las partes.
(f) (1) Es la intencién de la Legislatura que esta subdivision se interprete de manera consistente con la decisién en
Jaime G. v. HL (2018) ____ Cal.App.5th __ _, que requiere que el tribunal, al determinar que Se ha superado la presuncién
en la subdivision (a), haga hallazgos especificos sobre cada uno de los factores en la subdivision (b).(2) Si el tribunal
determina que se ha superado la presuncion en la subdivisidn (a), el tribunal debera declarar sus razones por escrito 0 en el
registro de por qué se cumple el parrafo (1) de la subdivision (b) y por qué los factores en el parrafo (2) de la subdivision (b),
en general, respalda los hallazgos legislativos en la Seccion 3020.
(g) En una audiencia probatoria o juicio en el que se solicitan las Ordenes de custodia y donde ha habido una
denuncia de violencia doméstica, el tribunal determinara si esta seccion se aplica antes de emitir una orden de custodia, a
menos que el tribunal determine que es necesaria una continuacion para determinar si se aplica esta seccién, en cuyo caso
el tribunal puede emitir una orden de custodia temporal por un periodo de tiempo razonable, siempre que la orden cumpla
con la Secci6n 3011, incluida, entre otras, la subdivision (e), y Seccién 3020.
(h) En un procedimiento de custodia o orden de restriccién en el que una parte ha alegado que la otra parte ha
perpetrado violencia doméstica de conformidad con los términos de esta seccidn, el tribunal informara a las partes de la
existencia de esta seccidn y les dara una Copia de esta seccién antes de cualquier mediacién de custodia en el caso.
