COMPLAINT – STRICT FORECLOSURE
Plaintiff THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK,
AS TRUSTEE FOR THE BENEFIT OF THE CERTIFICATEHOLDERS OF CWALT, INC.,
ALTERNATIVE LOAN TRUST 2005-33CB MORTGAGE PASS-THROUGH CERTIFICATES,
SERIES 2005-33CB, (herein after referred to as “Plaintiff”), by and through its Counsel, Stern &
Eisenberg, PC, does hereby bring the within Complaint against the Defendant and upon
information and belief, alleges as follows:
1. This is a strict foreclosure action brought to foreclose the named defendant interest in the
real property located at 108-54 Union Hall Street, Jamaica, NY 11433, (The “Property”).
2. On or about May 10, 2005, Paul Fishbein (“Fishbein”) executed and delivered to
Plaintiff’s a Note to Plaintiff’s predecessor-in-interest in the sum of $277,500.00 (the
“Note”). See Exhibit A.
3. As security for the repayment of the Note Fishbein executed and delivered a mortgage
(“Mortgage”) in the amount of $277,500.00 secured by the real property located at 108-
54 Union Hall Street, Jamaica, NY 11433 (the “Property”). See Exhibit B.

4. On July 13, 2009, the original Mortgage was transferred and delivered to Plaintiff and an
Assignment was sent for recorded. See Exhibit C.
5. Fishbein subsequently defaulted on the terms of the Note and Mortgage by failing to
make required payments resulting in the commencement of foreclosure proceedings on
August 25, 2014 in the Supreme Court of the State of New York, Queens County under
Index: 705995/2014 captioned The Bank of New York Mellon FKA The Bank of New
York as Trustee for the Benefit of the Certificateholders of CWALT, Inc., Alternative
Loan Trust 2005-33CB Mortgage Pass-Through Certificates, Series 2005-33CB v. Paul
Fishbein et al. (the “Foreclosure Action”).
6. Judgment of Foreclosure and Sale was entered on October 4, 2019. A copy of the entered
Judgment is attached as Exhibit D.
7. Pursuant to the Judgment, a foreclosure sale was held on November 17, 2023, at which
time the Property was sold to the Plaintiff, The Bank of New York Mellon FKA The Bank
of New York, As Trustee For The Benefit of The Certificateholders of Cwalt, Inc.,
Alternative Loan Trust 2005-33CB Mortgage Pass-Through Certificates, Series 2005-
33CB and a Referee’s Deed was recorded. A copy of the Referee’s Deed is attached as
Exhibit E.
8. After the sale, it was discovered that the named defendant The City of New York
Department of Housing, Preservation & Development Office of Housing Preservation
(“Defendants”) holds a lien on the Property by virtue of Judgment in the amount of
$27,150.00, which is junior lien to the lien held by Plaintiff and that the Defendant should
have been joined in the Foreclosure Action. Copy of the Judgment held by said
Defendant is attached as Exhibit F.
9. After the sale, it was discovered that the named defendant New York City Environmental
Control Board (“Defendants”) holds a several violations on the Property by virtue of lien
totaling the amount of $2,376.58, which is junior lien to the lien held by Plaintiff and that
the Defendant should have been joined in the Foreclosure Action. Copies of the
violations held by said Defendant is attached as Exhibit G.
10. At the time of the commencement of the foreclosure action and during all the
proceedings, Plaintiff was unaware that Defendants had or claimed to have a lien or
interest in or on the above-described premises besides that which was previously

identified. For that reason, Defendants were not named a party to the Foreclosure Action
with respect to their lien and Plaintiff at the time of the transfer was ignorant of any
outstanding claim on the part of Defendant.
11. Since Defendants’ interests were not foreclosed, their interest remains a cloud on title to
the Property.
12. As set forth in the filed Referee’s Report of Sale, Plaintiff was owed $741,978.07 at the
time of the sale. A copy of the filed Report of Sale is attached as Exhibit H.
13. The liens held by Defendants were recorded after the Mortgage foreclosed by Plaintiff. If
Defendants had been properly joined in the Foreclosure Action, said liens would have be
cut off and foreclosed.
WHEREFORE, Plaintiff demands judgment:
1. For an Order affixing Defendants time to redeem the property by paying to Plaintiff. the
full amount of the Judgment plus interest and costs or in the event of default or failure to
timely redeem that Defendants and all persons claiming under them be barred and
foreclosed of and from all right, title, and equity of redemption in and to the Premises and
any part of it.
2. For such other relief as the Court deems just and proper. -
