6 CS NAGEMENT LEASE AGREEMENT This document is a lease. It states the terms on which we are renting your apartment to you. 1 Owner: We are the Owner. Owner’s Name: Enclave West Hartford / Parc West In this lease, the Owner is called “We.” Tenant: You are the Tenant(s). Tenant’s Name: Tyler Pina In this lease, the Tenant is called “You.” Apartment: We are renting you an apartment known as: Complex Name: Enclave West Hartford Parc West Address: 160 Newington Rd. B204, West Hartford, CT 06110 In this lease it is called “your apartment.” Use. You must use your apartment as a private residence and for no other purpose. Only you and any other people listed on your rental application and in this Lease may live in your apartment. Term. This lease begins on 12/01/2022 and ends on 11/30/2023. Rent. You agree to pay Rent of $1,235.00 per month, plus Pet Rent of $0.00, plus Month-To-Month Fee of $0.00, plus Short Term Lease fee of $0.00, plus Furniture Rental of $0.00, plus Utility Fee of $0.00 for a total of $1,235.00 per month.. You will pay this rent each month on or before the first day of the month. We do not have to send you a notice each month saying that the rent is due. You shall make all rental payments in full. Payment or receipt of a rental payment of less than the amount stated in the lease shall be deemed to be nothing more than partial payment on that month’s account. Under no circumstances shall Owner's acceptance of a partial payment constitute accord and satisfaction. Nor will Owner’s acceptance of a partial payment forfeit Owner's right to collect the balance due on the account, despite any endorsement, stipulation, or other statement on any check. In the event of a check returned to us, for any reason, you will be charged $35.00 (Thirty-five). Cash is not accepted. Owner not responsible for any payments made with cash. Any modification to this lease must be made ina letter signed by the Owner, in which the Owner states and agrees to the modification. The Owner may accept any partial payment check with any conditional endorsement without prejudice to his/her right to recover the balance remaining due, or to pursue any other remedy available under this lease. You will send the rent to: Leasing Office, 43 Caya Rd West Hartford, CT 06119. If we send you a notice changing the address to which you are to send the rent, you will send the rent to the address contained in the notice. If we do not receive all your monthly rent payment by the tenth (10th) day of the month on which it is due, you must pay a late charge of Fifty ($50.00) Dollars of the outstanding balance. This late charge will be considered additional rent and will be due and payable immediately. Security Deposit. You have given us a security deposit of $1,025.00. We may keep all or part of your deposit if you do any of the following: (a) ) You do not pay your rent. (b) ) You damage your apartment. (c) You do not give us notice described in Paragraph 11 of this Lease YOU CANNOT USE YOUR SECURITY DEPOSIT FOR YOUR LAST MONTH’S RENT 10. Occupancy. (a) If your apartment is ready for you on the day this lease begins, you can move in on that day. () If your apartment is not ready for you on the day this lease begins but we tell you within thirty days that it is ready: Q) You can move in on the day it is ready; and Q) You must pay rent from the day your apartment is ready to the end of the month whether or not you move into your apartment. © If your apartment is not ready for you on the day this lease begins, and we do not tell you within thirty days that it is ready: a) You can move in whenever we tell you it is ready and pay rent from that day; or Q) We will give you your money back and cancel this lease. If you want your money back, you must ask us in writing. @ If your apartment is not ready on time, we are not liable to you for any loss, inconvenience or damage except as set forth in this Section. 11 TENANT’S TERMINATION OF RENTAL AGREEMENT You must give the Landlord Sixty (60) days written notice on or before the first of the month, prior to_the month in which your lease expires... You will be responsible for rent due through the end of the month in which you vacate the premises and turn in your keys to the office. This can only be in the 11) month or after the expiration of the lease. 12. Rules and Regulations. You agree to obey the Rules and Regulations attached to this lease. You also agree to obey any reasonable new Rules and Regulations we may make. Any new Rules and Regulations we make will take effect when we give you written notice of them. All present and future Rules and Regulations are part of this lease. 13. Notice. We can give you written notice in either of two ways: (a) We can mail it, postage prepaid, to your residence, office or third party representative. (b) We can leave it under your door. If we give you notice in one of these two ways, you will be considered to have received it, whether you actually receive it or not. We do not provide any storage in this building. @) You will not leave any flammable substances or other dangerous materials in your apartment. () You will remove items from the apartment which we tell you are dangerous 15, Parking. You may park 1 passenger car in the parking lot we designate. (a) You may not park any vehicle other than a private passenger automobile in the parking area. (b) You may not park any unregistered or unlicensed vehicles or any vehicles that are not drivable. ©) You mar h any vehiclesan @ The LANDLORD is not responsible for any loss or damage to any vehicle while itis on the property. We are not responsible for the action, damage or towing fees charged by the towing company when a vehicle is towed from the onsibil to conta your vehicle back and pay charge. the ©) You must fill out a parking sticker application and fill it out completely before being issued a sticker. The sticker should be placed IN THE LOWER LEFT SIDE OF THE REAR WINDOW, IN BACK OF THE DRIVER, SO THE TOW TRUCK OPERATOR CAN SEE IT EASILY. !f you change vehicles, return the old sticker in exchange for a new ‘one, give us notice of the changed vehicle. @® If you park any motor vehicle with a sticker in a visitor’s space, your will be towed AT YOUR EXPENSE. qa) Have your vehicle towed from where you parked it at your expense. We are not responsible for the action of the towing company when they remove any vehicle from the premises. 2) Store it on our property. @) Store it somewhere else. 16. Utilities. Landlord will pay for the following utilities, if checked: [X] cold water [X] hot water {] telephone [X] heat and at reasonable hours during cold seasons of year [X] gas {X] wastewater {X] Trash [] Electricity [] Cable tv (] other Tenant understands that these utilities shall be used in reasonable amounts. You may not reduce the rent if these utilities are not provided for reasons beyond the Landlord’s control. Cancellation by Landlord. We can cancel this lease on the following conditions: (a) The building containing your apartment is damaged and we decide not to repair it. (b) The building containing your apartment, or any part of it, is taken by any agency authorized by law for any reason. if we decide to cancel this lease, we will give you at least thirty (30) days’ written notice. 18. Moving Out. When you move out, you agree to do the following: (@) You will leave your apartment neat and clean and in good condition, including cleaning of bathroom tile and fixtures. Landlord Tenant Act. This lease is subject to Title 47A of the Connecticut General Statutes (The Landlord Tenant Act). If there is a conflict between this lease and the Landlord Tenant Act, the Landlord Tenant Act shall control but will not void other sections of the lease. 20. Default. You will be in default if you do any of the following: (a) You do not pay any rent or additional rent Ten (10) days from when it is due. (b) You move out of your apartment before this lease ends. ©) You let people other than those listed on your rental application live in your apartment. @ You do not observe the Rules and Regulations set forth as part of this lease. © You do any of the following repeatedly: qa) You do not pay any rent or additional rent when it is due. Q) You do not observe the terms of this lease and what you do one or more of the following: (a) It disturbs other tenants. (b) It adversely affects the health or safety of any person. ©) It interferes with any tenant’s use of his or her apartment, the building or the complex containing the building. @ It costs us money. If you are in default, we may do any or all of the following: (a) We can terminate this lease under the terms of the Landlord Tenant Act. (b) We can bring a summary process action against you to remove you from your apartment. ©) We can demand payment for all rent and additional rent due until the end of this lease. @ We can sue you for all unpaid rent and additional rent including a reasonable attorney fee and any other damages the law allows. (e) In the event of tenant default, the tenant shall be responsible for reimbursement of any rent concession which may have been issued by the landlord to the tenant. 21 Survival Upon Default. If you default in the payment of rent under the terms of this Lease and we commence an eviction proceeding against you seeking possession of the premises, then in the event, you shall not be relieved from your obligation for the unpaid balance of rent due for the Lease term. 22. Attorney’s Fees and Costs. You agree to pay our reasonable attorney's fees, sheriff’s fees, moving fees and court costs if the following happens: (@) We sue you for rent or other charges; or (b) We sue to put you out of your apartment; or © We sue you to enforce any other provision of this lease. Reasonable fees and costs are those awarded by a court under state and federal law. 23. Interruption of Services. If heat, electricity, water or other services to your apartment are interrupted, the following will apply: @ We will not be liable to you for any loss or inconvenience. (b) You may not deduct anything from your rent. 24, Landlord Not Liable. We will not be liable to you for any of the following: (a) Your belongings are stolen or damaged whether they were in your apartment, a storage area or elsewhere in the building. We can insist that you observe all of the terms of this lease even if one or both of the following happens: (a) You did something this lease said you should not do and we did not object. (b) You did not do something this lease said you should do and we did not object. We can sue you for overdue rent or other payments or take other legal against you even if the following happens: (@) You offer to pay part of what you owe us. (b) You offer to pay part of what you owe us and we accept it. © You send us a check with an endorsement or letter saying “paid in ful ” and we accept the check. 27. Entry. We will give you reasonable oral or written notice and ask your consent before we enter your apartment during reasonable hours to do any of the following: (a) Inspect your apartment. (b) Make repairs in your apartment. © Show your apartment to prospective tenants. @ Extermination and spray for vermin and insects. If you do not (a) or (b) above, we may enter your apartment for the reason we gave in our notice. M AN NTER OU M ANY TIM ITHO! CONTACTING YOU FIRST. 28. Assignment and Subleasing. You will not assign or sublease your apartment without our written permission. Even if we give you our permission, you will still be responsible for all the terms of this lease. 29. Entire agreement. You or we have made no promises to the other except those in this lease. 30. Joint and Several Liabilities. If more than one person signs this lease, we can look to any one of you to make all payments and to do anything else required under this lease. If your roommate moves out, you must still pay your entire rent. 31 Changes. This lease can be changed only in a written agreement signed by you and by us. If you continue possession in the premises after the expiration of the lease or any renewal hereof, such holding over shall not constitute a renewal or extension of this Lease, but we may, at our option, elect to treat you as one who has not removed at the end of the term, and there-upon be entitled to all the remedies against you provided by law in that situation, or we may elect, at our option, to construe such holding over as a tenancy from month to month, subject to all the terms and conditions of this lease, except as to the duration thereof, and in that event, you shall pay monthly rent in advance at the rate provided herein as effective during the last month of the demised term and an additional premium of $100 per month. Document ID: 190938 fe . RULES AND REGULATIONS @ Access. You must use the sidewalks, halls, fire escapes, elevators and stairs only for going to and from your apartment. (b) Plumbing. You must use the sinks, faucets, toilets, bathtubs and other plumbing only for the uses for which they were made. You must not put improper objects or substances down toilets or drains and garbage disposal. If our maintenance man must unplug your toilets or drains, you will be responsible for our cost. © Holes in Walls.You may not do the following: ay Put holes in the walls of your apartment or building. Q) Attach anything to the walls of your apartment or to the building. You may hang pictures and mirrors on the walls of your apartment if you use non-adhesive standard picture hooks. @ Trash, Put all trash and garbage in the dumpsters or other containers we provide. Do not hang or shake anything from windows. Do not send children to put the trash into the dumpster, it is your job as the parent to make sure it gets into the dumpster. Do not leave trash in the hallways. It smells and attracts mice and roaches. If any bags of trash are found in previously mentioned areas, there will be a $50.00 charge per bag. No bulk trash such as furniture, appliances, toys, mattresses, etc. may be left at any dumpster on the property. You will be responsible for the cost of cleanup and removal. Fees include $675 for a debris dumpster, $150 per mattress piece, and $25 per hour in labor per man. © Entrances. No one is allowed to sit or play on the concrete stairs or loiter in front of the building or sidewalks. Do not leave entrances to the building unlocked. It is for your security that the door is locked. ® State and Local Laws. You must comply with all state and local laws and regulations which apply to your department. If we are fined or incur other costs because you did not comply, you will pay us for these costs. (g) Fire Regulations. You must comply with the rules and regulations of any standard fire insurance policy as to the building or its content. You will not bring or keep anything in the building which will increase the cost of our fire insurance. qa) partment Q) That you will not disconnect the smoke detector. G) That if the smoke detector stops working any time you will contact this office (or other designated location) immediately. (h) Pets. (OU MAY NOT KEEP ANY ANIMALS, DOGS OR CATS, REPTILES OR BIRDS INYOUR APARTMENT WITHOUT OUR WRITTEN PERMISSION. WE MAY WITHDRAW OUR PERMISSION AT ANY TIME. @ Appliances. You may not use electric devices except safe household ones such as refrigerators, vacuum cleaners, toasters, irons, radios and TV’s. You may not use any electric devises which will overload the wiring in the building. You may not install a dishwasher, clothes washer, clothes dryer or air conditioner without our written permission. @ Water Beds. You may not put or use a waterbed in your apartment without our written permission. Should permission be granted, you must also obtain an insurance policy for any damage the water bed may cause should it rupture, and a copy be given to the LANDLORD. &®) Locks. You may ni han or add any | ‘ment with wri rmi: If we do give you our permission, you must give us a key to the new or changed lock at the time you install it. lf you are LOCKED OUT after hours, there will be a $50.00 charge paid in advance to the person assisting you. oO Cleaning. When you move out, you must sweep your apartment and clean all appliances and bathrooms. If you do not do so, we can keep a minimum of $75.00 from your security deposit to pay for cleaning plus any other charges we incur. (m) Minimum Heat. You will keep the heat above 40 degrees Fahrenheit in your apartment or set high enough so that the pipes will not freeze. (n) Absences. Document ID: 190938 * RULES AND REGULATIONS CONTINUED (0) Bicycles or Roller Blades. Do not ride bicycles or roller blades in the lobby area, hallways, or anywhere in this building. Bicycles are not to be left in hallways, in front of the building or lobby. @®) Exterminator. If we notify you that an exterminator is coming, you will remove food from cabinet and do whatever else is needed to assist the exterminator. If for any reason the exterminator cannot gain access to the apartment, tenant will be charged a $25.00 an hour fee per man, for our staff to prepare the apartment as requested. This fee will be added as additional rent and will be payable and due immediately with your next rent. @ Garbage Disposal. Do not put anything in your garbage disposal, if you have one, except food scraps. Always run water when garbage disposal is in use. If it breaks because you put something else in it or you did not run water, you must pay us to fix it. © Unit Transfer. You agree to pay a charge of $350.00, which is payable in advance. Landlord has the right to refuse a transfer request. () Notice. For any repairs including any water leaks or toilets running, Tenant agrees to notify the office immediately. If we fail to repair something, Tenant agrees that the rent is still due in full and no abatement in rent will be accepted. oO Snow Removal. There will be “No Parking” allowed on either side of the building during snow removal. Your vehicles must be moved when requested by Management; failure to comply will result in having your vehicle towed at the owner’s or your expense. Make arrangements to have someone move your vehicle if you are not going to be home.
