12          WHEREAS, on January 12, 2024, the Superior Court of Santa Cruz County issued an order
13   coordinating all product liability lawsuits pending against Future Motion, Inc. (“FMI”), and the
14   coordinated proceeding is now pending before the Court as In re Future Motion Onewheel Cases,
15   JCCP No. 5305 (“JCCP No. 5305”);
16          WHEREAS the following cases are product liability actions against FMI;
17                  Kurt Boeker v. Future Motion, Inc., Case No. 24CV00926;
18                  Christian Martinez v. Future Motion, Inc., Case No. 24CV01122;
19                  Eivin Kilcher v. Future Motion, Inc., Case No. 24CV00927;
20                  Steven Porentas v. Future Motion, Inc., Case No. 24CV00928;
21                  Johnathon Kelley v. Future Motion, Inc., Case No. 24CV01260;
22                  Thomas Varatta v. Future Motion, Inc., Case No. 24CV01264;
23                  Ryan Kennedy v. Future Motion, Inc.; Case No. 24CV01262;
24                  Brandt McDonough v. Future Motion, Inc.; Case No. 24CV01263.
25          WHEREAS the Parties agree that these cases should be added to JCCP No. 5305 because they
26   share several common questions of fact and law that predominate and are significant to the litigation
27   with the matters pending in JCCP No. 5305;

 1          WHEREAS THE Parties agree that coordination will promote the convenience of the Parties,

 2   witnesses and counsel, will promote the ends of justice, avoid duplicative and inconsistent rulings; and

 3   promote a more efficient use of judicial resources;

 4          WHEREAS the large number of actions within JCCP No. 5305 and potential add-on cases

 5   require exceptional judicial management to avoid placing unnecessary burdens on the Court or

 6   litigants, rendering them collectively complex;

 7          WHEREAS there is good cause that the coordination of this case is appropriate under the

 8   standards specified in Code of Civil Procedure § 404.1; and

 9          THEREFORE, the Parties hereby stipulate that the case shall be added to JCCP No. 5305, and

10   the Parties submit concurrently herewith for entry by this Court a proposed Order.

11          Plaintiffs’ counsel shall attach hereto a copy of the proof of service reflecting compliance with

12   the requirements of California Rule of Court Rule 3.544(a) as required by Case Management Order

13   No. 1 entered in JCCP No. 5305.
