FOR BEAZER HOMES TEXAS, L.P. AND PULTE HOMES OF TEXAS, L.P.
Benjamin Stewart, Alexander Brauer, Jason Marlin, and Bailey Brauer PLLC
hereby file their Motion to Withdraw as Counsel of Record for Beazer Homes Texas,
L.P. (“Beazer”) and Pulte Homes of Texas, L.P. (“Pulte”) and would show as follows:
1. Movants represent Defendants, Beazer and Pulte, and now seek to
withdraw as counsel of record.
2. Pulte retained new lead counsel in this litigation—Stephen Khoury—on
October 16, 2023.
3. Beazer’s new lead counsel—Richard Sayles—filed his entry of
appearance on December 19, 2023.
4. Messrs. Khoury and Sayles previously appeared before the Court as lead
counsel representing Pulte and Beazer, respectively, at a hearing on January 19,
2024. Messrs. Khoury and Sayles agree to the Motion and join in Movants’ request
that it be granted.

5. Movants have conferred with counsel for Plaintiff Megatel Homes III,
