IT IS HEREBY STIPULATED by and between Plaintiff and Defendant(s) as follows:
1 Defendant(s) is/are indebted to Plaintiff in the amount of $8,922.31 (Complaint amount of $9,222.31,
less credits of $300.00 since filing), plus court costs consisting of a filing fee in the amount of $320.85
and a service fee of $55.00, said court costs totaling $375.85, for a total amount owed of $9,298.16.
Note that payments received that have not cleared will be added back into the total amount owed if
payment instrument /transaction is dishonored or returned due to insufficient funds.
Furthermore, the parties also agree that the total amount owed may be satisfied for the sum of $9,222.31
according to the attached “Payment Schedule.” Upon successful payment by the Defendant(s) of all
amounts outlined in the Payment Schedule this account will be considered settled.
All payments shall be made payable to the above-named Plaintiff and delivered via U.S Mail to the
office of Zwicker & Associates, P. C., 80 Minuteman Road, Andover, MA 01810, and should reference
‘File Number 6340656’. Payments made above the minimum amount may be made in any month
without penalty. However, an extra payment or a payment in excess of the minimum monthly payment
shall not excuse the Defendant(s) from submitting at least the minimum payment in each succeeding
month.
Time is of the essence and should Defendant(s) fail to make any payment on or before the stated due
date, then Plaintiff shall immediately be free to pursue all available remedies to collect the balance due,
including any post-judgment interest accrued plus any additional costs incurred. The application for
Final Judgment shall be without further notice to the Defendant(s), any notice being specifically
waived, upon the presentation to the Court of a sworn certificate by Plaintiff showing the correct amount
remaining unpaid, and costs, if any.
