UPON reading and filing the annexed Affidavit of DANA SIEGEL sworn to on the 7th
day of May, 2024, the affirmation of PATRICIA BYRNE BLAIR, ESQ., the attorney for the
Plaintiff DANA SIEGEL, affinned to on the 8th day of May, 2024 and all the pleadings and
proceedings heretofore had herein and also in the related Landlord Tenant matter in the Fifth
District Court, Suffolk County, Islip Part entitled In the Matter of 180 Sagamore Corp. v. Dana
#1,"
Siegel; "John Doe "Jane Doe #1 under Landlord Tenant, Index No. LT 1275/23 IS,

LET the Defendant 180 SAGAMORE CORP. Show Cause at an IAS Part _ of this
Court to be held at the Courthouse located at One Court Street, Riverhead, New York on the
day of May 2024, at 2:00 in the afternoon of that day or as soon thereafter as counsel can
be heard,
WHY, DANA SIEGEL'S application for an Order pursuant to CPLR Article 63 for a
Preliminary Injunction and a Temporary Restraining Order to stay the eviction that has been filed
by the Defendant and warrant of eviction that will be served the Suffolk County Sheriff on the
Plaintiff Dana Siegel in the related Landlord/Tenant proceeding under Landlord/Tenant Index
No. LT 1275/23 IS and why the Sheriff of the County of Suffolk should also not be stayed from
evicting Dana Siegel from the real property located at 131 Belle Avenue, Lake Ronkonkoma,
New York, until after a determination is made as to the Plaintiff's application regarding a
determination as to title to the property in question located at 131 Belle Avenue, Lake
Ronkonkoma, New York 11779, together with such other and further relief as to the Court may
seem just and proper; and sufficient cause appearing therefore, it is further
ORDERED that pending the hearing and final detennination of this application that the
Landlord/Tenant action currently pending in this District Court, First District, Islip Part and more

particularly entitled "In the Matter of 180 Sagamore Corp. v. Dana Siegel; "John Doe "Jane
Doe #1, and bearing Suffolk County First District Court Index No. LT 1275/23 IS be stayed; and
it is further
ORDERED that the Sheriff of the County of Suffolk be directed to cease attempting to
enforce a Warrant of Eviction until said hearing and final detennination is had; and it is further

ORDERED that service of a copy of this Order together with the papers upon which it
was granted be served upon the Defendant 180 SAGAMORE CORP, , by serving their attorneys
Alicia M. Menechino, Esq., 545 Main Road, Riverhead, New York 11901 and by serving the
Sheriff of the County of Suffolk at their office located at 360 Yaphank Avenue, Suite 1A,
Yaphank, New York 11980 by overnight mail, return receipt requested on or before the
day of May 2024, be deemed good and sufficient service.
