LANDLORD'S FAILURE TO RECEIVE RENT

RE: Premises: Approximately 5900 square feet plus separate basement space
located directly under the premises located at 2256 Forest Avenue, Staten Island,
10303. Block 1685, Lots 50 and 55.
PLEASE TAKE that Musleh-Forest LLC as successor-
NOTICE, Realty
in-interest to 2252-2270 Forest Avenue Realty LLC ("Landlord") is the owner and
landlord of the Premises.
PLEASE TAKE FURTHER NOTICE, that Clean Rite Centers-Forest
Ave., LLC ("Tenant") is in possession of the Premises pursuant to a written lease
agreement dated December 2008 and Rider the Store Lease dated December 2008
between Owner's predecessor-in-interest, as landlord and Tenant (Collectively, the
"Lease").
PLEASE TAKE FURTHER NOTICE, that Landlord has not received full
and complete payment of rent from Tenant as set forth in the annexed rent ledger
within seven (7) days of the date specified in the Lease that such payments of rent
and additional rent were due and payable.

PLEASE TAKE FURTHER NOTICE, that Tenant is indebted to
Landlord for rent past due and owing for the Premises for the Period of April 1,
2020 and including March 1, 2024 in the amount of $819,434.00. The foregoing is
without prejudice to any additional amounts owed by Tenant, including, but not
limited to, additional rent.
PLEASE TAKE FURTHER NOTICE, that Tenant is indebted to
Landlord for the Tenants portion of outstanding property taxes for the years 2020
and 2022 in the amount of $18,241.00.
PLEASE TAKE FURTHER NOTICE, that Tenant is responsible for the
Water Bills for the Property and currently, as of March 15, 2024, Tenant owes
$176,425.00.
PLEASE TAKE FURTHER NOTICE, that this notice is being served on
Tenant pursuant to Section 235-e(d) of the Real Property Law and other applicable
provisions of law.
PLEASE TAKE FURTHER NOTICE, that this notice is being given to
Tenant without prejudice to Landlords rights and remedies under the Lease and
applicable law, all o which are reserved; and this Notice shall not be construed as
any waiver or modification of Tenants obligations to Landlord under the Lease or
any other applicable law.
