I, Lindsey Young, declare as follows:
I am an attorney licensed to practice before this Court and all courts of the State of
California and am an associate with the law firm of Gibson, Dunn & Crutcher LLP (“Gibson Dunn”).
I am one of the attorneys of record for Plaintiffs First Street Holdings LLC (“First Street”), S.J.
Bayshore Development LLC (“S.J. Bayshore”), S.J. Sweetwater Holdings LLC (“S.J. Sweetwater”),
and Brian Bumb (“Brian”) (together, “Plaintiffs”) in the above-captioned action. I submit this
declaration in support of Plaintiffs’ Ex Parte Application for an Order Shortening Time to Hear
Plaintiffs’ Motion to Compel the Deposition of Timothy Bumb. I have personal knowledge of the facts
set forth herein, except as to those stated on information and belief and, as to those, I am informed and
believe them to be true.
Plaintiffs served a notice of deposition on Tim on February 16, 2024. Tim has not
served any objections to that notice of deposition. Attached hereto as is a true and correct
copy of the Notice of Deposition for Personal Appearance to Timothy Bumb, dated February 16, 2024.
Over the subsequent weeks, the parties met and conferred in good faith via email to
agree upon a date for Tim’s deposition. Both parties offered proposed dates but did not ultimately
reach agreement on a date when all relevant parties were available. During those discussions, Tim’s
counsel never indicated that Tim would be unavailable for over a month right before the Sutter’s Place
trial. If Tim’s counsel had indicated that Tim would be unavailable that entire month, Plaintiffs would
have acted differently. Attached hereto as is a true and correct copy of the email
correspondence between myself and Ben Pulliam and Abraham Andrade (both of Coblentz Patch Duffy
& Bass LLP) “RE: First Street Holdings v. Timothy Bumb; Sutter’s Place Inc. v. Gregory Bumb -
At that point, with a mediation scheduled for April 9, 2024, Plaintiffs determined it
would be reasonable to wait until after the mediation to continue discussions, given the possibility that
the mediation might obviate the need for the deposition in the first place. After the failed mediation,
Plaintiffs followed up with Tim’s counsel the very next day, April 10, 2024, to schedule Tim’s

deposition. Tim’s counsel responded that Tim was “unavailable for deposition before the May 6, 2024
trial in Sutter’s Place,” and that Tim is only available “the last two weeks of May” because he is “out-
of-state.”
Plaintiffs had previously offered to stay the litigation pending the parties’

PLEASE TAKE NOTICE that, pursuant to California Code of Civil Procedure §§ 2025.010

As we have indicated repeatedly, Timothy and his counsel are unavailable for a deposi on at this late date, mere weeks
before the er’s Place trial. Your demand to depose him now—a er years of delay and over a month of radio
silence—is unfair and will materially and prejudicially interfere with our and his ability to prepare for trial in that case.
As you point out, the Court may hear a summary judgment mo on less than 30 days before trial. Code of Civil
Procedure § 437c(a)(3) (“The mo on shall be heard no later than 30 days before the date of trial, unless the court for
good cause orders otherwise.”). In other words, there is no jurisdic onal bar to having this mo on heard on June
Beroiz v. Wahl (2000) 84 Cal.App.4th 485, 493, n.4. We believe good cause exists here.
If you want to depose Timothy, you can do so in May, a er the er’s Place trial.
