DATE: April 29, 2024 17 TIME: 8:30 A.M. 18 DEPT: T2 ACTION COMMENCED: March 17, 2023 19 20 21 I. 22 FACTUAL STATEMENT: The Defendants have purported to have filed some motions to further compel discovery responses. First, they issued the motions via a link that was NOT accessible. Then, they sent an email confirming that the documents were too large to send via email and were subsequently not delivered. Then, they mailed such documents via a flash drive that had NO content within. Finally, they sent the documents but did NOT include the moving papers, ONLY the OBJECTION AND OPPOSITION TO MOTION TO FURTHER COMPEL DISCOVERY - 1 1 declarations. Despite begging pleas for due process rights in order to properly oppose such 2 motions, the Defendants slapped us in the face and ignored such basic principles, in grave 3 violation of law. 4 MEMORANDUM OF POINTS AND AUTHORITIES: 5 6 II. THE MOTION SHOULD BE DENIED AS A VIOLATION 7 OF DUE PROCESS: 8 People in the Marines, Army, Air Force, Space Force, Navy, and Coast Guard, go : 9 overseas to fight for the freedoms most take for granted in this country. One of the most vital 10 freedoms and rights in this country is that of due process. Notice and an opportunity to be heard 11 12 is the most fundamental right that a citizen has in America, full stop! The Defendants herein 13 only served a “declaration” and NOT the moving papers to anyone, so one may ask, how can 14 the undersigned oppose the motion? They cannot! 15 A landmark Court of Appeals decision recently held, “Was the notice of motion alone 16 sufficient? On this question, the trial court responded with an emphatic “no,” citing the 17 18 requirements of section 1010. We agree. Section 1010 states in pertinent part as follows: 19 ‘Notices must be in writing, and the notice of a motion, other than for a new trial, must state 20 when, and the grounds upon which it will be made, and the papers, if any, upon which it is to be 21 based. If any such paper has not previously been served upon the party to be notified and 22 was not filed by him, a copy of such paper must accompany the notice.’” (Emphasis 23 24 Added). See Golf & Tennis Pro Shop, Inc. v. Superior Court (2022) 84 Cal.App. 5th 127, 137- 25 138. The Court goes on to say: “Section 101 O’s requirement “is for the benefit of the party 26 upon whom the notice is served,” to make him or her aware of the issues to be raised in the 27 motion. (Hecq v. Conner (1928) 203 Cal. 504, 506 [265 P. 180]; see also Kinda v. Carpenter 28 OBJECTION AND OPPOSITION TO MOTION TO FURTHER COMPEL DISCOVERY - 2 1 (2016) 247 CalApp. 4th 1268, 1277 [203 Cal. Rptr. 3d 183] (Kinda). As stated in Kinda: “The 2 purpose of the notice requirements ‘is to cause the moving party to “sufficiently define the 3 issues for the information and attention of the adverse party and the court.’” (Luri v. Greenwald 4 (2003) 107 Cal.App. 4th 1119, 1125 [132 Cal. Rptr. 2d 680] quoting Hernandez v. National 5 6 Dairy Products (1954) 126 Cal.App. 2d 490, 493 [272 P. 2d 799].” See Golf& Tennis Pro 7 Shop, Inc. v. Superior Court (2022) 84 Cal.App. 5th 127, 137-138. 8 Here, the Defendants provided the mere “declaration” but NOT the moving papers, and 9 as Courts have universally ruled, this is not sufficient. Failure to identify the papers upon which 10 the notice of motion was based is not sufficient. “We note in Wesinstein v. Blumberg (2018) 25 11 12 — Cal.App. 5th 316 [235 Cal. Rptr. 3d 658] a case on which the trial court and real parties in 13 — interest relied a notice of motion unaccompanied by supporting papers was deemed 14 insufficient even though it had specified the papers upon which it would be based. (Id. at p. 15 318).” See also, Golf & Tennis Pro Shop, Inc. v. Superior Court (2022) 84 Cal.App. 5th 127, 16 139, footnote 10. 17 18 III. CONCLUSION: 19 Not many people get second chances in life, and here, the Defendants not only failed to 20 meet the requirements of the basic California Code of Civil Procedure, but also FAILED to 21 comply with the fundamental requirements of the due process rights! 22 What has happened here is a tragedy, the tragedy that the big insurance company is 23 24 using to try to sideline the fight of equality and justice. The reality is that the Defendants did 25 NOT comply with the requirements of the California Code of Civil Procedure nor the 26 Constitution’s due process mandates, by requiring that service of the moving papers to be 27 served on the opposing parties. Given the evidence forthwith, and the arguments within this 28 OBJECTION AND OPPOSITION TO MOTION TO FURTHER COMPEL DISCOVERY - 3 1 notice of objection, this motion must be denied.
