Plaintiffs, BAO NGUYEN AND ANH THI PHAM, hereby sue Defendant,
FLORIDA INSURANCE GUARANTY ASSOCIATION (“FIGA”), based on the
following:
1 This action is for breach of a homeowners’ insurance contract.
2 This action exceeds $50,000.00, exclusive of interest, attorneys’ fees, and
costs.
Plaintiffs are individuals who, at all times material hereto, had an ownership
and insurable interests in residential property in Sarasota County, Florida.
At all times materials hereto, Plaintiffs’ property was insured under a Policy
issued by United Property & Casualty Insurance Co.
As of the filing of this lawsuit, United Property & Casualty Insurance Co
(“Insolvent Insurer”) has been declared insolvent.
Insolvent Insurer was a Florida corporation qualified to do business in Florida

and which, at all times material hereto, conducted business in Sarasota,
Florida.
Defendant FIGA is a Florida nonprofit corporation created by the Florida
Legislature to service claims submitted by policyholders to insurance carriers
that Florida has declared insolvent.
Defendant has at all times material hereto been conducting business in
Sarasota County, Florida.
Venue is proper in Sarasota County, Florida because the Policy contract,
which forms the subject matter of this lawsuit, was executed and operative in
Sarasota County, Florida.
10 At all times material hereto, Insolvent Insurer maintained with Plaintiffs a
Policy of homeowner’s insurance in exchange for premiums paid; i.e. a
contract.
11 Insolvent Insurer insured Plaintiffs’ property as follows:

Sarasota, FL 34233-3515
b Policy No: UHV34178140801.
12 Insolvent Insurer inspected dwelling when first issuing Policy.
13 As a result, Insolvent Insurer has an underwriting file.
14 Underwriting file documents physical condition of dwelling prior to the
subject loss.
15 This is an HO-3 policy a/k/a an “all risk” policy.
16 Plaintiffs are in possession of a certified copy of the policy issued by the
Insolvent Insurer. (Exhibit A)
17 Insolvent Insurer was in possession of the Policy.
18 Defendant, therefore, is in possession of the Policy.
19 Policy for each period is in the exclusive control of Defendant.
20 A copy of the Policy is incorporated by reference.
21 Plaintiffs’ dwelling sustained direct physical loss caused by a weather event
while the Policy was in effect.
22 Plaintiffs’ loss is covered under the Policy.
21 Plaintiffs reported to Insolvent Insurer the loss and resulting damages.
22. Insolvent Insurer assigned claim number is 022422FL00178853.
23 Insolvent Insurer’s date of loss is September 28, 2022.
24 Insolvent Insurer denied that the Policy provides coverage for Plaintiffs’
damages.
25 Insolvent Insurer materially breached the Policy by failing to fully pay for this
loss.
26 As a result, Plaintiffs suffered damages.
27 Plaintiffs retained counsel to protect all rights under the policy.
28 Plaintiffs are responsible, absent agreement or an order of this Court, for all
reasonable attorney’s fees and costs.
29 Plaintiffs complied with all conditions precedent to recover under the Policy.
30 Insolvent Insurer was subsequently declared insolvent.
31 Defendant FIGA was appointed to pay Insolvent Insurer’s outstanding claims
for property and casualty policies pursuant to Chapter 631, Florida Statutes
and FIGA was substituted as the statutory guarantor of Insolvent Insurer’s
contractual obligations to the Plaintiffs under the Policy.
32 FIGA has affirmatively denied the subject claim.
33 Otherwise, FIGA has failed to fully compensate Plaintiffs for the damages to
the Plaintiffs’ property.
34 FIGA has failed to properly indemnify the Plaintiffs in violation of FIGA’s
statutory duty to do so under Chapter 631, Florida Statutes.
WHEREFORE, Plaintiffs demand:
a judgment against Defendant for all damage and resulting loss set forth
above, these losses are ongoing and will continue in the future;
attorneys’ fees and costs pursuant to 627.428 (attorney’s fees), 57.041
(costs) and 92.231 (expert witness fees), Florida Statutes, or otherwise;
and
trial by jury.

Florida Department of Financial Services of intent to initiate litigation, the insurer’s
responsibilities, and process by which the insurer will respond to the notice as required by
Florida law.
As a condition precedent to filing suit, you, the “claimant”, must provide the Florida
Department of Financial Services written notice of your intent to initiate litigation. The notice
must be provided at least 10 business days prior to filing suit and must contain the
following information:
. That the notice is provided pursuant to this section;
. The alleged acts or omissions of the insurer giving rise to the suit, which may
include a denial of coverage;
If provided by an attorney or other representative, that a copy of the notice was
provided to the “claimant”;
If the notice is provided following a denial of coverage, an estimate of damages, if
known; and
If the notice is provided following acts or omissions by the insurer other than denial
of coverage, both of the following:
. The “presuit settlement demand”, which must itemize damages, attorney
fees, and costs; and

with HO 043 06 21 - Water Damage Exclusion Endorsement. The following changes affect your coverage:
. Clarified in opening paragraph that the deletion of Accidental Discharge Or Overflow Of Water Or
Steam, under SECTION - PERILS INSURED AGAINST, applies to all forms and endorsements
applicable to the policy.
Added exclusion for constant repeated seepage regardless of source.
