                   WAIVER OF CITATION, WAIVER OF BOND,
   CONSENT TO APPOINTLIENT OF INDEPENDENT ADMINISTRATOR WITHOUT BOND
                 AND AFFIDAVIT IN SUPPORT OF APPLICATION

NOW COMES LYDIA DIANE LUSTY a/k/a LYDIA DIANE DURON who, after being duly sworn,
deposes and says:

    1.   I am the same person named     in Decedent's Will as ”Lydia Diane Lusty".
    2.   I have read the Application     fo Probate of Holographic Will, Declaratory Judgment of
         Partial Intestacy, Heirship Determination, and for Letters of Administration Without Bond
         which shall be filed herein and acknowledge receipt of a copy of the same.
    3.   Pursuant to Texas Estates Code §401.004(b), I hereby waive the issuance and return of
         service upon me in this cause, accept service herein, and enter an appearance in this cause
         for all purposes and agree that the same may be heard at any time hereafter without further
         notice to me.
    4.   I agree on the advisability of having an independent administration herein, and that the
         Applicant be granted the power of sale of real and personal property of the Estate.
    5.   I hereby waive the requirement of a bond for the personal representative to be appointed
         in Decedent's estate as required by Texas Estates Code §401.005 and request the Court to
         appoint such personal representative without bond.
    6.   I hereby designate and agree to the appointment of PATRICK FABIAN DURON, who is a
         qualified person, to serve as Independent Administrator Without Bond.
    7.   I hereby request that no other action shall be had in this Court in relation to the settlement
         of Decedent’s estate other than the return of an Inventory, Appraisement and List of
         Claims of Decedent’ s estate, or an affidavitIn ieu of such inventory.        -       ,
