22 COME NOW defendants LESLIE VELASQUEZ and ANTONIO VELASQUEZ and
23 answer the complaint on file herein as follows:
24 1. Under the provisions of Section 431.30 of the Code of Civil Procedure of the State
25 of California, these answering defendants generally deny each and every allegation of the
26 complaint, and the whole thereof, and further deny that plaintiff has been or is now or will be
27 damaged to the extent alleged or to any other extent.

1 AS AND FOR FURTHER, SEPARATE AND DISTINCT AFFIRMATIVE
2 DEFENSES, ANSWERING DEFENDANTS AVER:
3 FIRST AFFIRMATIVE DEFENSE
4 2. The incident or incidents complained of by plaintiff herein were caused, in whole
5 or in part, by the negligence of the plaintiff. Any recovery by plaintiff in this case must be
6 reduced by that percentage of the plaintiff’s negligence which contributed to the incident or
7 incidents.
8 SECOND AFFIRMATIVE DEFENSE
9 3. Plaintiff failed to use reasonable care to mitigate, in whole or in part, the damages
10 alleged in the complaint.
11 THIRD AFFIRMATIVE DEFENSE
12 4. Damages complained of by plaintiff herein were caused, in whole or in part, by
13 acts and omissions of persons other than these answering defendants, which other persons
14 may or may not be named as defendants in this action. These answering defendants should
15 only be required to pay that portion of the plaintiff’s damages attributable to these answering
16 defendants pursuant to Civil Code sections 1431.2 and/or 1432.
17 FOURTH AFFIRMATIVE DEFENSE
18 5. The complaint and/or causes of action therein fail to state facts sufficient to
19 constitute a cause of action against these answering defendants.
20 WHEREFORE, defendants pray:
21 1. That plaintiff takes nothing;
22 2. For costs of suit herein; and
23 3. For such other and further relief as the Court deems just and proper.
