Patricia Whitney, Attorney at Law, has been retained by your landlord to evict you for non-payment of
rent. Ms. Whitney is not your attorney. You are receiving this Debt Validation Notice via mail, at the first
direct communication from Ms. Whitney’s office.
For the purposes of the Fair Debt Collection Practices Act, this Notice is a communication from a debt
collector. Any information you provide will be used for the purposes of collecting that debt.
Unless you notify this office within 30 days after receiving this notice to advise that you dispute the
validity of this debt or any portion thereof, this debt will be assumed to be valid.
If you provide notice in writing within 30 days from receiving this notice that you dispute the validity of
this debt or any portion thereof, verification of the debt will be obtained or a copy of the judgment
obtained and you will be mailed a copy of such judgment or verification.
If you make a request in writing within 30 days after receiving this notice, you will be provided with the
name and address of the original creditor, if different from the current creditor.
The amount of the debt excluding the costs and statutory fees is listed in paragraph four (4) of the
Eviction Action Complaint. The name of the creditor to whom the debt is owed is the Plaintiff (the first
name listed at the top left of the Eviction Action Complaint).
If an attorney represents you with regard to this debt, please refer this letter to your attorney. If you are
involved in an active bankruptcy case or if this debt has been discharged in a bankruptcy case, please
refer this letter to your bankruptcy attorney so that we may be notified. This notice does not affect your
dealings with the Court, and in particular, does not change the time at which you must answer the
Complaint. This notice does not affect the attorney’s relations with the Court, and the attorney may file
papers in the Eviction Action according to the Court’s rules and judge’s instructions.
If you choose to discuss settlement of this eviction action with the attorney for your landlord, you sign
the acknowledgment at the bottom of this Notice, take a photo of it, and email the photo to
patricia@pwhitneylaw.com before noon on the day before the date of the court hearing. By signing this
document, you are acknowledging that you have received this Notice. You are not required to sign this
Notice, but if you do not sign, Ms. Whitney will not discuss settlement with you.
