BEFORE ME, the undersigned authority, on this day personally appeared Lavelle
Demond Callahan, after being duly sworn, stated as follows:
1. My name is Lavelle Demond Callahan and I am a distributee of the Estate of
DARLENE CALLAHAN PETTIT, Deceased, (“Decedent”) under statutes of descent and
distribution.
2. I have received a copy of the application which has been or will be filed asking for the
probate of the estate of DARLENE CALLAHAN PETTIT.
3. As provided in Section 202.056 of the Texas Estates Code, I state the following:
a. I do not wish to be served with citation in the above matter; and
b. I have received a copy of the Application to Determine Heirship.
4. I do not object to the offer of Decedent’s intestate estate for probate.
5. I state that the facts and statements contained in the Application to Determine Heirship
are true and correct to the best of my knowledge.
6. I understand that, by signing this affidavit waiving citation and waiving objection, I
enter my appearance in this case for all purposes, and I waive the issuance and service of
process, and agree that the Application may be amended or heard at any time without further
notice to me.
