THE ISSUANCE OF AN OCCUPATIONAL LICENSE
(A FINAL DISPOSITIVE ORDER)
On this day, came to be heard, the above entitled and numbered cause, and the Petitioner,
DONNA THERESA LECK, appeared by and through his attorney, JUAN R. ZAMORA The
Court being the opinion that it has jurisdiction of the subject matter of such petition and that this
proceeding may be ex parte in nature; and the Petitioner having announced ready, the Court
proceeded to review the evidence and argument of counsel, and finding that the material
allegations in Petitioner’s petition are substantially correct and that the Petitioner should be
allowed to operate a motor vehicle in the performance of an occupation or trade or for
transportation to and from the place at which the Petitioner practices the Petitioner’s occupational
or trade.
The Court find that Petitioner has an essential need for the issuance of an Occupational
restriction on Petitioner’s driving privileges as provided by Section 521.248 of the Texas
Transportation Code.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that the
Petitioner shall have the right to operate a motor vehicle in the performance of an occupation or
trade or for transportation to and from the place at which the Petitioner practices the Petitioner’s
occupation or trade, TO-WIT:

IT IS THEREFORE ORDERED that there is no hour restriction is hereby waived, as
provided for in Section 521.248 of the Texas Transportation Code.
IS FURTHER ORDERED that a Certified Copy of the petition and this Court Order setting
out my findings and providing the restrictions is to be forwarded to the Department of Public
Safety of the State of Texas by the Clerk of this Court. Upon receipt of a certified copy of this
order and after compliance with Chapter 601 of the Texas Transportation Code (by providing
evidence of financial responsibility), the Texas Department of Public Safety shall issue an
Occupational License to the Petitioner. The Occupational License must refer on its face to this
court order. The occupational license issued hereby remains valid until the end of the period of
suspension of the Petitioner’s regular driver’s license.
IT IS FURTHER ORDERED that this Order Authorizing the issuance of an Occupational
License is effective immediately.
IT IS FURTHER ORDERED that a guardian interlock device to be obtained by Petitioner
IT IS FURTHER ORDERED that the Petitioner may use a certified copy of this Order
Authorizing the Issuance of an Occupational License as a restricted license until the 120TH day
after the date on which this order takes effect.
