dated April 11, 2024, and upon all of the papers and proceedings had and filed heretofore herein,
the undersigned will move this Court thereof before the Judge sitting, at the Supreme Court of the
State of New York, to be held in and for the County of Monroe at the Courthouse thereof, located
at 99 Exchange Blvd, 5th Floor, Rochester NY 14614, on May 8, 2024, at 9:30 o'clock in the
forenoon of that day or as soon thereafter as counsel can be heard for an Order: (a) pursuant to
CPLR 5239 determining that Plaintiff’s interests in the Bank of America account belonging to
Respondents PLAN B HOSPITALITY CONSULTING, LLC / PLAN B HOSPITALITY
CONSULTING LLC / PLAN B HOSPITALITY CONSULTING / PLAN B HOSPITALITY /
BRITISH INVESTMENTS LLC, ROGER LEE YOUNG is superior to the interest of 800
FUNDING LLC in the same account; (b) directing Bank of America, pursuant to CPLR 5225(b),
to pay and deliver over to Plaintiff all funds and safe deposit boxes held, if any, in the name of the
judgment debtors including those held jointly with any other individual or entity, and for such
other and further relief as to the Court may seem just and proper.
