UPON the annexed Affirmation of DENIS SHANNON, JR., sworn to on April 7, 2024,
and the Petition of Michael F. Nestor, Esq. dated April 9, 2024, and upon all prior pleadings and
proceedings heretofore and herein and General Obligation Law §5-1705(a), amended effective
January 1, 2011, mandating these proceedings be "... brought on only by Order to Show
Cause", and sufficient reason appearing therefrom:
LET Respondents, FIRST BERKSHIRE HATHAWAY LIFE INSURANCE
COMPANY, BHG STRUCTURED SETTLEMENTS, INC. and DENIS SHANNON, JR., show
cause before this Court, at Part of the Supreme Court of the State of New York, County of
Queens, at , , New York, before the Presiding Judge
on the day of , 2024, at o'clock, or as soon thereafter as counsel
can be heard, why this Court should not enter an Order approving the Transfer of Structured
Settlement Payment Rights of Payee, DENIS SHANNON, JR., and for any and all further relief
that this Court deems just and proper.
Sufficient cause appearing therefore, LET overnight mail service of a copy of this Order,
Petition and a copy of the supporting papers upon Payee, DENIS SHANNON, JR. and service
via overnight mail to Annuity Issuer, FIRST BERKSHIRE HATHAWAY LIFE INSURANCE
COMPANY, and Settlement Obligor, BHG STRUCTURED SETTLEMENTS, INC., pursuant to
CPLR _R2214(d) on or before , 2024 (which date shall be at least 20 days
before the time at which the Petition is noticed to be heard pursuant to GOL § 5-1705(c))
be deemed sufficient service.
