CLAIRE KUSY affirms the following to be true under penalty of perjury and pursuant to
CPLR 2106:
1. That I am a translator employed by Fasken Martineau DuMoulin S.E.N.C.R.L.,
s.r.1. ("Fasken"), the Plaintiff in this action, seeking recognition of a judgment issued by the
Superior Court of the Province of Quebec, District of Montreal, in favor of Fasken and against
Bemardo Kohn (the "Application")
"Judgment"
2. That the translation of the accompanying issued by the Superior Court
of Québec on February 9, 2024, filed as part of the Application, which were written in a foreign
language (i.e., French), was made by the deponent at the request of Bradley P. Pollina, Esq.,
attorney for Fasken in this proceeding.
3. That deponent is ably qualified to make the translation of said documents into
English by virtue of the following qualifications: I am an attorney and have been a member in
good standing of the Bar of Québec (Barreau du Quëbec) since 1998. I am also a certified
translator and have been a member in good standing of the professional order of translators in
Québec (Ordre des traducteurs, terminologues et interprètes agréés du Québec) since 2022.
4. That deponent's translation is made pursuant to CPLR 2101(b), and is a true and
accurate and complete translation of the said documents.
