2 I, Karl P. Schlecht, declare as follows:
3 1. I am a partner at the law firm Tressler LLP, the attorney of record for Defendants
4 Jennifer Runyon (“Runyon”) and Welcome Home Property Management (“Welcome Home”)
5 (collectively, “Defendants”) in this action. I am licensed to practice law in the State of California
6 and before this Court. I have personal, first-hand knowledge of the matters set forth in this
7 Declaration and, if called upon, I could and would competently testify thereto. This declaration is
8 in support of Defendants’ Motion to Compel Further Responses to Written Discovery and
9 Defendants’ Request for Sanctions.
10 Verified Complaint
11 2. On or about March 17, 2023, Plaintiff Nilka Cooks (“Plaintiff”) filed their verified
12 Complaint for Damages with the Superior Court of Kern County. The Complaint alleges the
13 following causes of action: (1) Violation of California Civil Code § 1942.4; (2) Tortious Breach
14 of the Warranty of Habitability; (3) Private Nuisance; (4) Business and Professions Code §
15 17,200, ET SEQ; (5) Negligence; (6) Breach of Covenant of Quiet Enjoyment; (7) Intentional
16 Infliction of Emotional Distress; (8) Negligence Per Se; (9) Violation of Consumer Legal
17 Remedies Act, California Civil Code § 1750, ET SEQ; (10) Violation of California Civil Code §
18 1947.12; and (10) Violation of California Civil Code § 1947.12. A true and correct copy of
19 Plaintiff’s verified Complaint for Damages filed on March 17, 2023, is attached as Exhibit A.
20 3. On or around September 21, 2023, Defendants answered Plaintiff’s Verified
21 Complaint. Defendants’ Answer to Plaintiff’s Verified Complaint has been omitted for simplicity.

6. On or about January 29, 2024, Defendants served upon Plaintiff the following

8. On or about February 29, 2024, my office sent a detailed meet and confer letter

identifying the numerous deficiencies in Plaintiff’s discovery responses including, but not limited
14
to, Plaintiff’s improper general objections, improper boilerplate objections, and Plaintiff’s
15
inadequate, evasive, and non-code-compliant responses. A true and correct copy of Defendants’
16
February 29, 2024, meet and confer letter concerning Plaintiff’s deficient responses is attached
17
hereto as Exhibit E. The meet and confer letter requested Plaintiff’s response by March 7, 2024.
18
9. To date, my office has not received any response to Defendants’ Meet and Confer
19
Letter and/or further supplemental responses to any of Defendants’ Amended Discovery Requests
20
propounded to Plaintiff.

10. My office has spent considerable time in connection with preparing Defendants’
23
Motions to Compel Responses to Form Interrogatories – General (Set One), Special
24
Interrogatories (Set One), and Requests for Production of Documents (Set One), propounded to

Plaintiff.

11. Elvin Vu, an associate attorney at my office, spent at least four (4) hours meeting

12. Jihoon Kim, an associate attorney at my office, spent time drafting the present

Motions to Compel Further Responses to Welcome Home Defendant’s Amended Discovery

Requests. His rate is $245 per hour.

13. Binh Nguyen, a law clerk at my office, conducted legal research, compiled all

Plaintiff’s responses together, and created the first template drafts of the motions for me and the

two attorneys mentioned above to work on. Her rate is $100 per hour.

3. For the purposes of this lawsuit, the "Plaintiff' or "Plaintiffs" shall be used
2 interchangeably, and shall mean to include PlaintiffNILKA COOKS, who at all time

relevant hereto was a tenant in the Subject.Properly.

4. At all relevant times, Defendants were aware of, authorized and/or ratified Plaintiffs'

occupancy of the Subject Property during the term or each Defendant's ownership,

7 management or control of the Subject Property. All Plaintiffs were intended
8 beneficiaries or their residential leases, with the right to enforce the leases.
Defendants constituted the landlords under each ofPlaintiff's leases by virtue or

times consented to the number of people living in each or the Plaintiffs' unit, either

INDIVIDUAL; PARS-15 LLC., A CALirORNIA LIMITED LIABILITY

COMPANY; WELCOME HOME PROPERTY MANAGEMENT, AN ENTITY;

19 AND DOES 1-100, INCLUSIVE, who at all times relevant hereto were managers,
20 owners, or agents of the Subject Property. Said Defendants coordinated with each

other or ratified such acts to cause the great harms to all or the Plaintiffs.

5. On information and belief, at all times mentioned herein, Defendants were the agents,

servants, employees, successors-in-interest, assigns, subsidiaries, and/ox joint

scope, and authority of said agency, employment, successor-in-interest, assigmnent,

a principal and was negligent in the selection and hiring and.retention of ec1,ch and

every Defendant as an agent, employee, successor-in-interest, assignment, subsidiary,

7 6. Whenever reference is made to individuals who are not named as Defendants in this
8 Complaint, but who are or were employees, agents, associates, joint venturers,

mmrngers, directors, board members, partners, trustees and beneficiaries of

Defendants and/or Defendants' companies or organizations, Plaintiffs assert that the
11
conduct of such individuals at all relevant times was on behalf of Defendants and was
12
13 within the course and scope of their employment or agency.
14 7. Plaintiffs arc ignorant of the true names and capacities of Defendants sued as DOES
15
1-100, inclusive, and therefore sue these Defendants by such fictitious IHIIJJeS and
16
capacities. On information and belief, each of the Defendants fictitiously named as a
17
DOE is legally responsible, negligently or in some other actionable manner, for the
18
19 events and happenings hereinafter referred to, and thereby proximately and legally
20 caused the i1~uries and damages to Plaintiffs as alleged. Plaintiffs will amend this
21
Complaint to insert the true names and/or capacities of such fictitiously named
22
Defendar.ts when the same have been ascertained.
