CESAR AGUSTO Case ID: CI24-100 GIRON THIS MATTER is before the Court upon the pleading filing and the service perfected in the above-captioned matter. The Court schedules a pretrial hearing for 8:30 a.m. on May 8, 2024 and shall be in accordance with the Local Rules of the Second Judicial District: https://supremecourt.nebraska.gov/external-court-rules/district-court- local-rules/district2 Parties and counsel shall attend the pretrial date. Attendance of the parties may be excused only if the Court approves the same prior to the pretrial. Parties and counsel should be prepared to discuss any remaining issues that have not otherwise been resolved. This is only for a pretrial, NO MOTIONS will be taken up at this time. If a motion is filed by a party and calendared on the Court's Friday docket call, the pretrial may be continued to the Friday docket by agreement of counsel and to notify the Court's Bailiff. If there are minor children at issue in this proceeding then this case is governed by the Nebraska Parenting Act (Neb.Rev.Stat.) Sections 43-2920-43-2943 and Local rule 2-9. The parties shall either register for "what about the Children" or "Reaching Beyond Conflict". Barring an emergency, no hearing for temporary allowances will be held unless proof is submitted by the moving party showing completion for said parenting class. If this matter is a dissolution, legal separation, or annulment proceeding, and the assets and debts are at issue, the Plaintiff shall have 60 days from today's date to prepare a Property Statement. Plaintiff shall then furnish a copy to the opposing party and the opposing party shall then complete the Property Statement by adding to it any additional property and estimated valuation of the property listed. This shall be completed by the opposing party within 30 days after receiving the Property Statement. Thereafter the completed Property Statement shall be submitted to the Court at the pretrial hearing. The Property Statement shall not be filed with the Clerk. Mediation shall be attempted within 60 days of this order. If the parties are unable to agree upon a mediator, the parties shall mediate the issues through the Concord Center. Trial will not be scheduled unless mediation has been attempted or the Court permits waiver of mediation. Once the parties have completed a Parenting Plan or Partial Mediated Parenting Plan, they shall file a Stipulated Order Approving Parenting Plan. Trial shall be limited to the unresolved issues indicated by the Parenting Plan. Objections to the Parenting Plan, either before or after the Stipulated Order Approving Parenting Plan, shall be filed by the moving party no less than 60 days prior to trial unless excused by order of the Court. The objection shall be set for hearing and said hearing shall be conducted pursuant to the Local Rules of the Second Judicial District.
