MOTION TO WAIVE IN-PERSON APPEARANCE
OF ADMINISTRATOR
ROBERT POBUDA, Administrator of the ESTATE OF DONALD POBUDA,
DECEASED, is gravely ill with esophageal cancer and is at present hospitalized. He does not
expect to leave the hospital before his death.
A final accounting hearing was held December 12, 2023, with the Court’s auditor
approving the accounting. The Administrator appeared in person.
ALL ISSUES BUT ONE was covered in the hearing.
The only unresolved issue concerned the distribution of the net inheritance to two minor
children. The court had asked for the credentials of the minors’ guardian and it turned out that the
guardian was custodial only and not guardian of the minors’ estates.
The Court announced that an attorney ad litem would be appointed for the minors and if
the ad litem had no objection to the final accounting and its designated distribution to the minors,
their distributions would be deposited to the registry of the Court, with the ad litem fee being
deducted from the minors’ respective distribution.
WHEREFORE, ALL OTHER MATTERS HAVING ALREADY BEEN
PRESENTED TO THE COURT BY THE ADMINISTRATOR IN PERSON and the minors’
distribution being the sole final issue, the Administrator requests, because of his health condition,
that the Court allow him to be represented in person by his attorney of record at the hearing
scheduled for March 27, 2024.
