                   PLEASE TAKE NOTICE, that upon the annexed Affirmation of Richard S. Finkel, dated

          March 19, 2024, together with the exhibits annexed thereto, the accompanying Memorandum of

          Law, and upon all prior pleadings and proceedings had herein, Defendants Steven Baronoff and

          Mindy Baronoff (incorrectly sued herein as Stephen and Mindy Baranoff) will move this Court,

          before    a Justice to        be assigned,   at the   Courthouse   located   at   1   Court   Street

          Riverhead, NY 11901, or at another location designated by the Court, on April 2, 2024, at 9:30

          A.M. or as soon thereafter as counsel may be heard, for an order dismissing the Complaint in this

          action pursuant to CPLR S 3211(a)1), (7), and (10), and l00l(a) on the grounds, inter alia, that

          the Complaint fails to state a cause of action against the Defendants, and that a proper and

          necessary party to this action has not been joined.

                   PLEASE TAKE FURTHER NOTICE, that pursuant to CPLR Section 2214, Plaintiffs

          answering papers, if any, must be served and filed by March 26, 2024; and

                   PLEASE TAKE FURTHER NOTICE, that Respondents' reply papers, if any, must be

          served and filed no later than April 1, 2024.
