NOTICE IS HEREBY GIVEN, that an action has been commenced and is now pending in the
Supreme Court of Dutchess County upon the Complaint of the above named Plaintiff against the above
named defendants for the foreclosure of a mortgage dated February 12, 2003, executed by Mary Lois
Pennachio AKA Mary Pennachio to secure the sum of $110,000.00. The Mortgage was recorded at
Instrument Number 01-2003-4221 in the Office of the Dutchess County Clerk on February 24, 2003.
Plaintiff is also holder of a mortgage dated February 14, 2007 executed by Mary Lois Pennachio AKA
Mary Pennachio to secure the sum of $99,648.10 and recorded at Instrument Number 01-2007-3079 in
the Office of the Dutchess County Clerk on March 1, 2007. Said mortgage was consolidated with the
mortgage referred to at Instrument No: 01-2003-4221 by a Consolidation, Extension and Modification
Agreement executed by Mary Lois Pennachio AKA Mary Pennachio dated February 14, 2007 and
recorded March 1, 2007 at Instrument Number 01-2007-3080 in the Office of the Dutchess County
Clerk to form a single lien in the amount of $204,000.00. The consolidated mortgage was subsequently
assigned by an assignment executed February 14, 2007 and recorded on March 1, 2007, in the Office of
the Dutchess County Clerk at Instrument Number 01-2007-447A. The consolidated mortgage was
subsequently assigned by an assignment executed May 25, 2011 and recorded on June 7, 2011, in the
Office of the Dutchess County Clerk at Instrument Number 01-2011-1026A. The consolidated mortgage
was subsequently assigned by an assignment executed May 9, 2014 and recorded on June 4, 2014, in the
Office of the Dutchess County Clerk at Instrument Number 01-2014-1626A. Said Mortgage was

subsequently modified by a Loan Modification Agreement executed by Mary Lois Pennachio AKA
Mary Pennachio on March 26, 2015 and recorded May 6, 2015 in Instrument Number 01-2015-3079 in
the Office of the Dutchess County Clerk. The mortgage was subsequently modified on October 25,
2021.
AND, NOTICE IS FURTHER GIVEN, that the mortgaged premises described in such
mortgage(s) affected by the foreclosure action, were, at the time of the commencement of the action, and
at the time of the filing of this Notice, situated in Dutchess County, New York, and are described in
"Schedule A - Legal Description" attached hereto and made a part hereof.
Dutchess County Clerk is directed to index this Notice against the names of all the Defendant(s)

Schedule A - Legal Description
All that plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the Town of Dover, County of Dutchess and State of New York, known and designated as
Lot No. 89 on a certain map entitled Subdivision Plat prepared for "Wood Winds" made by Fowler &
Dickinson and filed in the Dutchess County Clerk's Office on August 6, 1993 as Map No. 9753
Together with an easement for ingress and egress over any private streets in the above subdivision from
the nearest public highway to the premises described above.
