The following parties have the following interest in the property: (a) That Plaintiff PHH Mortgage Corporation, successor by merger to Ocwen Loan Servicing, LLC, is the holder of the mortgage described herein; (b) Defendant Richard Graham is the mortgagor(s) described herein and may reside at 2713 Louisiana Ave S, St Louis Park, MN 55426; (c) John Doe and Mary Roe, whose identities are not yet known may have an interest and may occupy the subject property. BACKGROUND 2. That by Warranty Deed dated February 1, 2005, and recorded March 28, 2005 as Document No. 8551485 with the Hennepin County Recorder, Richard Graham acquired title to that certain real estate located in Hennepin County, commonly referred to as 2713 Louisiana Ave S, St Louis Park, MN 55426, legally described as follows: Page 1 of 4 MN11057 27-CV-24-4627 Filed in District Court State of Minnesota 3/27/2024 3:39 PM Lots 27 and 28, Block 6, The Bronx, Hennepin County, Minnesota (hereinafter “Subject Property”). 3. Richard Graham executed Promissory Note (Note) dated March 26, 2008 in the original principal sum of $268,467.00, which Note was negotiated to Ace Mortgage Funding, Inc. A copy of the Note is attached hereto as Exhibit A. 4. To secure the Note, Richard Graham, an unmarried man executed and delivered a first mortgage (Mortgage) to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Ace Mortgage Funding, Inc., its successors and assigns, as mortgagee, dated March 26, 2008, and recorded on April 1, 2008, in the Office of the Hennepin County Recorder as Document No. 9116043. A copy of the Mortgage is attached hereto as Exhibit B. 5. The Mortgage was assigned as follows: To Ocwen Loan Servicing, LLC, by an Assignment of Mortgage (Assignment) dated March 31, 2016, and recorded on April 12, 2016, in the Office of the Hennepin County Recorder as Document No. A10301957. That PHH Mortgage Corporation is the successor by merger to Ocwen Loan Servicing, LLC. A copy of the Assignment is attached hereto as Exhibit C. COUNT I FORECLOSURE BY ACTION 6. Plaintiff restates and re-alleges the preceding paragraphs as if fully set forth herein. 7. The Mortgage provides that, upon default in the terms and conditions of the Mortgage, or the Note, the mortgagee, its successors and assigns may declare the entire sum secured by said Mortgage immediately due and payable. 8. Based upon the acceleration clause contained in the Mortgage, Plaintiff hereby elects to declare the total amount of principal and interest outstanding on said Mortgage immediately due and payable. The outstanding principal balance is $187,530.53. 10. Plaintiff has complied with all conditions precedent to foreclosure and/or acceleration of the indebtedness of the subject Mortgage and all notice requirements of the statutes and/or the subject Mortgage. 11. No other action or proceeding at law or in equity has been commenced for the collection of the debt secured by the Mortgage or any part thereof. WHEREFORE, Plaintiff requests the following relief: 1. An order for a foreclosure judgment in favor of the Plaintiff and against Defendant Richard Graham for the principal sum of $187,530.53 plus interest, costs and disbursements, and including reasonable attorneys’ fees as allowed by law and in such amount as the Court shall determine. 2. An order granting Plaintiff a Decree of Mortgage Foreclosure of the Mortgage described herein to satisfy said judgment. 3. An order for judgment in favor of Plaintiff and against Richard Graham for any deficiency existing after the sale of the above described premises. 4. An order directing that the premises described herein be sold by the Sheriff of Hennepin County in the manner provided by law on execution sale of real estate and the proceeds of said sale be applied, first, to the payment of costs and disbursements of said sale, and second, on the principal of said judgment, and providing that the purchaser at said sale, or its successors or assigns be declared the absolute owner of said premises at said sale, subject only to the right of redemption. 5.
