DECLARATION OF DAVID J. TAPPEINER
2. The hearing on plaintiffs’ ex parte application was originally set for March 21,
2024. I provided notice of the hearing on all interested parties by 10:00 a.m. on March 20, 2024.
3. At the Trial Confirmation Conference scheduled by the Court on March 20, 2024,
the Court continued the hearing on Plaintiffs’ ex parte application to March 28, 2024 at 9:00 a.m.
Counsel for all defendants who have appeared in this matter were present at that hearing and
advised of the continued hearing date.
4. Following the Trial Confirmation Conference, I also emailed counsel for the parties
who have appeared in this matter, as well as defendant Patrick Leahy, about the new date, time,
and location of the hearing on plaintiffs’ ex parte application.
5. I have attempted to contact defendant Patrick Leahy by telephone at the phone
number last provided by him, 805-729-3881. That number appears to be disconnected. The relief
sought in plaintiffs’ ex parte application does not impact Mr. Leahy. He has been provided with
email and U.S. Mail of all matters to date and there have been no mail returns or any email notices
indicating that the documents served upon Mr. Leahy have not reached him at his given email
address.
