On Saturday, September 16, 2023, at approximately 1430 hours, I responded to 8730 North Highway 1,
Micco, Brevard County, Florida 32976 in reference to a trespass.
Upon arrival, I completed an investigation that developed probable cause, via victim statement and video,
stated that on September 16, 2023, at approximately 1406 hours, Mr. Berton Lombard (Defendant) did,
without being authorized, licensed, or invited willfully enter upon or remain in any property other than a
structure or conveyance the property of Mr. Rene Duque, as to which notice against entering or remaining
was given, either by actual communication or by posting, or fencing or cultivation as described in
810.011, {or} said property was the unenclosed curtilage of a dwelling and Mr. Lombard entered or
remained with the intent to commit the offense of trespass, contrary to Florida Statute 810.09(1)(a) and
(2)(a). Mr. Lombard was previously issued a trespass warning from the property and was confirmed still
active, via Teletype - Brevard County Sheriff’s Office. Previous case number for the trespass warning is
Case Number 2020-00257600.
