Dear Judge Reyna:
At the February 29, 2024, hearing on Plaintiff’s Motion for Sanctions, the Court made
certain rulings on the record, with regard to the DWQs issued by defense counsel and the standing
Rule 11 agreement on DWQs.
The transcript from the Feb. 29th hearing was received on March 7th, and after carefully
reading the transcript, Plaintiff’s counsel prepared a proposed Order which reflected the Court’s
rulings.
On March 11, 2024, the “proposed” Order was sent to defense counsel for his review. (Ex.
A) Mr. Dominguez would not agree with the Order as prepared and instead sent a “revised”
version. (Ex. B) After going back and forth with defense counsel via e-mail, Plaintiff’s counsel
filed the original proposed Order for the Judge’s consideration. We felt this was important, since
the Court had specifically directed the parties to submit such an Order. (Ex. C, e-mail exchange
with defense counsel.)
