Upon the annexed Petition/Affirmation of Marvin Newberg, Esq., dated March 7, 2024,
and upon the Commission issued by the Kern County Superior Court of the State of California,
and upon all prior pleadings and proceedings had herein, let the Offices of Brian P. Rourke, PC,
and Juan Goyzueta, M.D., Respondents, show cause before a Motion Term of this Court, held at
the Sullivan County Courthouse, 414 Broadway, Monticello, NY 12701 at the day of
March, 2024, at o'clock or as soon thereafter as counsel can be heard, why an Order
should not be entered pursuant to CPLR 3119 and CPLR 3124 compelling and directing
Respondents to comply with the previously served Subpoena Duces Tecum against them, and for
such other and further relief as the Court deems just and proper, and
IT IS FURTHER ORDERED, that answering Affidavits, if any, shall be served and filed
at least seven days before the return date herein,
AND IT IS FURTHER ORDERED, that service of a copy of this Order to Show Cause
and the papers upon which it is based upon Respondent Law Office of Brian P. Rourke, PC by
email and first class mail and upon Maureen M. Arciero, Esq., attorney for Respondent Juan
Goyzueta, MD, on behalf of Respondent Juan Goyzueta, MD via email and by first class mail on
or before the _ day of March, 2024 be deemed good and sufficient service thereof.
