Pursuant to Code of Civil Procedure section 2025.310, the deposition will 23 take place on October 5, 2023 at 9:30 a.m., at Miller Starr Regalia, 1331 N. California Blvd., Suite 24 600, Walnut Creek, CA 94596. 25 Said deposition shall be taken before a duly qualified shorthand reporter or other 26 officer authorized to administer oaths and take depositions. DISCOVERY HOMES intends to 27 cause the proceedings to be recorded by stenographic methods and further reserves the right to 28 record the deposition by audio or video technology. Please contact the noticing attorney at 3 least five (5) calendar days prior to the deposition to advise that it is your desire to appear via 4 remote videoconferencing so that the necessary credentials, call-in numbers, testing and 5 information, if necessary, can be provided to you prior to the proceedings. 6 Pursuant to Code of Civil Procedure section 2025.230, CITY is required to 7 designate and produce at the deposition those of its officers, directors, managing agents, 8 employees, and/or agents who are most qualified to testify on its behalf as to the following matters 9 to the extent such information is known or reasonably available to the deponent: 10 DEFINITIONS 11 1. “YOU,” “YOUR,” or “CITY” shall mean and refer to Respondent and 12 Defendant CITY and its agents, attorneys, and all other persons acting or purporting to act on its 13 behalf. 14 2. The term “PETITION” means the petition and complaint filed by 15 DISCOVERY HOMES in this action. 16 3. The term “FINAL MAP” means and refers to the final subdivision map 17 DISCOVERY HOMES submitted to the CITY on or about June 6, 2022 for the 17 unit residential 18 development project located at 2431 West Imola Avenue in the City of Napa. 19 4. “DOCUMENT” or “DOCUMENTS” include all WRITINGS (as defined 20 below) and means and refers to any matter or thing, including but not limited to any computer or 21 other electronic media, which constitutes or contains an original or duplicate (as those terms are 22 defined respectively at Sections 255 and 260 of the Evidence Code) writing which YOU have in 23 YOUR possession, custody or control whose subject matter, in whole or in part, either directly or 24 indirectly in any way pertains, relates or refers to the subject matter of the COMPLAINT. 25 5. “WRITING” OR “WRITINGS” means and includes all written, recorded or 26 graphic matters, however produced or reproduced and whether or not privileged. This definition 27 includes, but is not limited to, the meaning ascribed to that term at section 250 of the Evidence 28 Code including any and all originals, copies or drafts of any and all of the following: memoranda, DBI-58567\2837013.1 -2- SECOND AMENDED NOTICE OF DEPOSITION OF PERSON MOST QUALIFIED AT CITY OF NAPA AND REQUEST FOR PRODUCTION OF DOCUMENTS Page 1190 1 reports, studies, licenses, advertisements, brochures, circulars, pamphlets, accounts, records, notes, 2 assignments, escrow instructions, notices, requests for notice, deeds, deeds of trust, promissory 3 notes, summaries, schedules, contracts or agreements, drawings, sketches, charts, graphs, indexes, 4 data sheets, invoices, orders or acknowledgements, calendars, appointment books, diaries, reports, 5 forecasts or appraisals, correspondence, memoranda, letters, telegrams, telexes or cables prepared, 6 drafted, received or sent, tapes, transcripts or recordings, photographs, pictures or films, computer 7 programs, or data or other digital, graphic, symbolic, recorded or written materials of any nature 8 whatsoever (including DOCUMENTS at any time in YOUR possession, custody or control). 9 6. “PERSON” or “PERSONS” means any legal entity or entities including, 10 without limitation, any individual, firm, partnership, corporation, association, trust, organization, 11 public agency or body, joint venture or other form of business organization entity or arrangement. 12 7. “COMMUNICATION” means any instance in which words, information, 13 images, or data is transferred or transmitted by or between PERSONS by whatever manner or 14 means, and regardless of how or by whom the communication was initiated, including but not 15 limited to correspondence or other written communication, e-mail or other forms of electronic or 16 digital communication, conversation, telecommunication, instructions, meetings, requests, 17 demands, conferences, and postings of information or material for view by others. 18 8. The phrase “RELATING TO” and “RELATE TO” shall be construed in the 19 broadest sense, and means and includes constituting, concerning, alluding to, responding to, 20 connected with, commenting on, with respect to, about, regarding, discussing, involving, showing, 21 describing, reflecting, analyzing, evidencing or comprising. 22 9. “ALL” includes “ANY,” “EACH,” and “EVERY,” and vice versa. 23 10. Whenever the conjunctive “AND” is used, it shall be construed to include 24 the disjunctive “OR” and vice versa. 25 TOPICS OF EXAMINATION 26 1. The CITY’s determination that the FINAL MAP was insufficient. 27 2. The CITY’s processing of final map submittals under the Subdivision Map 28 Act through to approval by the CITY’s City Council. The CITY’s custom and practice for determining whether final map 2 submittals under the Subdivision Map Act are sufficient for processing through to approval by the 3 CITY’s City Council. 4 4. The role of the City Engineer in the CITY’s processing of final map 5 approvals. 6 5. ANY instance in which the CITY has accepted the filing of a final map 7 where ANY conditions of approval remained outstanding or unsatisfied at the time of filing. 8 6. ANY instance in which the CITY has accepted the filing of a final map 9 where the final map was not yet ready for approval by the CITY’s City Council at the time of 10 filing. 11 7. ANY instance in which the CITY has rejected the filing of a final map for 12 its failure to conform with all requirements and conditions of the applicable tentative map at the 13 time of filing. 14 8. ANY instance in which the CITY has rejected the filing of a final map for 15 its failure to be ready for approval by the CITY’s City Council at the time of filing. 16 9.
