The plaintiff alleges:
1. Plaintiff is a Bank.
2. Upon information and belief, defendant(s) reside(s) in, or transaction took place in, the county in which this action was
commenced.
3. On September 15, 2021, the plaintiff and defendant(s) entered into a contract whereby plaintiff agreed to provide defendant(s)
a loan secured by certain collateral. A copy of the agreement is attached hereto as Exhibit "1". Defendant was assigned account
number ending in 0958.
4. Pursuant to CPLR §105(q-1), the original creditor is COMMUNITY BANK, N.A..
5. The last four digits of the account number printed on the final notice is 0958.
6. On or about November 15, 2021, defendant(s) defaulted on the repayment of said loan. Defendant's last payment was made
on 10/15/2021 in the amount of $158.85. As such, defendant is in default under the terms of the agreement.
7. Due to defendant(s) default, plaintiff took possession of the collateral and sold it in a commercially reasonable manner at a
public or private sale.
8. The date the final notice of the account was provided to the defendant was 07/19/2022.
9. The balance printed on the final notice was $2,695.89.
10. After the sale of the collateral, plaintiff accelerated the loan and demanded payment in full on February 1, 2022.
11. The total balance owed is: $2,638.07, which consists of a principal balance of $1,622.76; finance charge of $0.00; fees
attomeys'
imposed by the Original Creditor of $760.00; Collection costs of $0.00; fees of $0.00; interest of $255.31; and other fees of
$0.00.
WHEREFORE, the plaintiff demands judgment against defendant(s) in the sum of $2,638.07 with interest at the rate of 7.74%
from February 1, 2022; costs and disbursements of this action.
