16   1.     I am an attorney duly licensed to practice before all the Courts of the State of California and
17   Attorney for CKS PRIME INVESTMENTS LLC ("Plaintiff"). The following declaration is made of
18   my own knowledge and if sworn as a witness, I would and could competently testify thereto.
19   2.     This suit involves a debt which has been assigned to the plaintiffs; thus this suit may not be
20   brought in small claims court under CCP § 116.420.
21   3.     The amount sought in the complaint is less than or equal to $5,000.00.
22   4.     Under Business and Professions Code Section 6322.1(c)(1), where a claim for money damages
23   falls within the monetary jurisdiction of the small claims court and is filed by an assignee who is
24   prohibited from filing or maintaining a claim pursuant to CCP § 116.420, the filing party is entitled to
25   a $44.00 reduction from the uniform filing fee.
