PLEASE TAKE NOTICE, that upon the annexed affirmation of Alfred E. Donnellan,
dated March 11, 2024, the Memorandum of Law dated March 11, 2024, the Statement of Material
Facts dated March 11, 2024, the exhibits annexed thereto, and all prior pleadings and proceedings
heretofore had herein, defendant Houlihan/Lawrence Inc. (“Defendant”) will move this Court
before the Honorable Linda S. Jamieson, at the Commercial Part of the Supreme Court, County of
Westchester, at the Courthouse located at 111 Dr. Martin Luther King Jr. Boulevard, White Plains,
New York 10601, on the 14th day of May, 2024 at 9:30 a.m., or as soon thereafter as counsel can
be heard for an Order, pursuant to CPLR §3212, granting summary judgment against Plaintiffs,
together with such other, and further and different relief that this Court may deem just and proper
in the circumstances and the costs and disbursements of this motion.
PLEASE TAKE FURTHER NOTICE that pursuant to the Joint Proposed Scheduling
and Case Management Order filed on the NYSCEF system on February 23, 2024, any opposition
papers shall be filed on or before April 22, 2024 and any reply papers shall be filed on or before
May 13, 2024.
