Upon reading and filing the Petition of the above-mentioned Petitioner, sworn to on the 22nd day
of February 2024, the affirmation of Laura Wong-Pan dated February 26, 2024, and the exhibits
annexed thereto, and all the pleadings and proceedings had herein, it is hereby ORDERED:
LET the Respondents appear and show cause before the assigned judge, Hon.
________________ of the Supreme Court of the State of New York, County of Dutchess, at the
Courthouse located at 10 Market Street, Poughkeepsie, New York 12601 on the 18th day of
April 2024 at 9:30 a.m. or as soon thereafter as counsel can be heard, why an Order should not
be entered granting leave to the Petitioner pursuant to Section 3813(2-a) of Education Law to
serve and file a late Notice of Claim as against Respondents, ULSTER BOCES, KAREN
DRUCKER and MARITA KITCHELL, granting the Petitioners an Order directing that the
attached proposed Notice of Claim be deemed served upon Respondents nunc pro tunc and why
such other and further relief should not be granted to the Petitioner herein as this Court deems
just and proper; and
Sufficient cause being alleged, it is
ORDERED, that service of a copy of this Order and the papers upon which it is based
and the annexed Notice of Claim upon the Respondents on or before the 15th day of March, 2025
shall be deemed good and sufficient service thereof. Opposition, if any, shall be served by April
1, 2024. Reply shall be served by April 15, 2024.
