FILED: ORANGE COUNTY CLERK 03/05/2024 INDEX NO. EF001828-2024 NYSCEF DOC. NO. 4 RECEIVED NYSCEF: 03/04/2024 Printed: 03/02/2024 CASE SUPPLEMENTAL NARRATIVE REPORT Page: 1 Narrative #:1 Officer Rank/Name: PO MICHAEL M NAPOLI 22:04:00 CITY OF MIDDLETOWN POLICB DEPARTMENT Number. cM-00808-24 Department: Case DD Number: Blotter/CC #: CM-005309-24 I On 03/02/2024 at about 1921. I responded to 45 Knapp Ave with PO Harlan, for a report of a domestic at that location. Upon arrival, we met with the caller Andrew Antona. He stated that his daughter Abigail Antona, and her Boyfriend Charles Rubino were upstairs in the house and began to argue with each other. Andrew stated that the two became louder and more disruptive at which point he told them both to leave. Andrew stated that once he told the two that he was calling the·police, both Abigail and Charles left the house. Andrew then stated that a short time later he heard a pounding at his front door but did not answer the door until Police arrived. While inside of the home completing a DIR, a loud noise was heard just outside of the home, and a male voice yelled "GET THE FUCK OUT NIGGA". Officers then exited the house and located Abigail Antona, who was walking toward the home on the sidewalk. Charles then emerged from a side yard of the neighboring home and appeared visibly upset. I pointed my TASER at Charles and ordered him to go to his knees, and I then handcuffed him to the rear. Charles then HOSPITAL" said "YOU KNOW WHAT FUCK YOU I'M KILLING MYSELF TONIGHT TAKE ME TO THE Charles stated that he wished to kill himself several times during my interaction with him. Charles was placed into the rear of my patrol vehicle (#34) and immediately began banging his head off of the metal partition in the car, which caused a laceration to his forehead which caused him to begin to bleed. Charles then began kicking the inside of the locked car door with both feet, causing the door to bulge outward. I opened the patrol car door and removed Charles to prevent him from further harming himself, and he was kept outside of the car until EMS arrived to transport him. EMS then transported Charles to Garnet Health where he was to be treated for his head wound and later taken into the BHU for further evaluation. While in the emergency room, Charles told medical staff that he had also stabbed himself in the leg earlier in the day, and that wound was also being evaluated. Photographs of the bloodied backseat of car #34 as well as of Charles Rubino's wound were taken and uploaded to Evidence.com. Use of force form completed.
