PLEASE TAKE NOTICE, that, pursuant to Judiciary Law Section 475, Capetola & Divins,
P.C., as former counsel for the above-named Plaintiff, KIM BURKE, hereby asserts a charging lien in
the sum of FIFTY NINE THOUSAND EIGHT HUNDRED AND FIFTY EIGHT D OLLARS AND
FORTY FIVE CENTS($59,858.45), for legal services, costs, and disbursements in connection withtheir
representation of KIM BURKE, upon any cause of action, claim, or counterclaim KIM BURKE may
have in this action and/or related actions. Said lien shall attach to any verdict, report, determination,
decision,judgrnent and/or final order in the Plaintiff's favor and the proceeds thereof in whatever hands
they may come. Said lien cannot be affected by any settlement between the parties before or after
judgment, final order or determination, or dismissal/withdrawal of the action.
DEMAND IS HEREBY
MADE, that the parties hereto, and their respective attorneys, shall
give notice,.prior to distribution
of any assets of any nature, marital or otherwise, to the Plaintiff, to the
undersigned lienor of same, and shall further provide the undersigned lienor with notice of settlement
and/or notice of entry of any judgment or Order relative to the distribution of any assets of any nature,
marital or otherwise, to Plaintiff.
DEMAND IS HEREBY MADE, that, in the event that any attorney is hereinafter substituted
as counsel , it shall providethe incoming attomey with a copy of this charging lien and shall notify
Capetola & Divins, P.C. of the identification of incoming counsel.
