THIS MATTER came upon the Court’s attention on the stipulation agreement (“the
Agreement”) between Plaintiff Dennis McDermott (“the Plaintiff’) and Defendants the City of
Clearwater, a municipality; Frank Hibbard; Mark Bunker; Kathleen Beckman; David Allbritton;
Lina Teixeira; and David Margolis (“the Defendants” and together with the Plaintiff, “the
Parties”). After consideration of the Agreement and otherwise being fully advised of the premises,
it is hereby
ORDERED AND ADJUDGED:
1. The Agreement filed with the Court is RATIFIED AND APPROVED.
2. All claims asserted by the Plaintiff against the Defendants are hereby DISMISSED WITH
PREJUDICE without the Plaintiff obtaining any relief from the Court or the Defendants.
3. The Parties are individually responsible for payment of their own attorney’s fees and costs.
4. Any claims asserted by plaintiff Paul Gagliano against the Defendants may continue.
