The issues in the above entitled action having duly come for decision by way of Motion
for Summary Judgment before Hon. Kenneth R. Fisher, JSC. of this Supreme Court, Monroe
County, held at the Courthouse thereof located at 545 Hall of Justice, 99 Exchange Blvd.,
Rochester, New York 14614, and the plaintiff RBS Citizens, N.A., having duly moved the Court
by its attorneys, Simon, Galasso and Frantz, PLC and the defendants NICEPRICEUSA, INC.
a/k/a NICE PRICE USA INC. and LEONARD CARON having failed to oppose such motion,
the issues were considered and the Court ordered such relief by Order dated September {> >
2011, in favor of plaintiff RBS Citizens, N.A., and against the defendants NICEPRICEUSA,
INC. a/k/a NICE PRICE USA INC. and LEONARD CARON in the principal sum of One

Warwick,. Rhode Island 02886 does. recover of the defendants NICEPRICEUSA, INC. a/k/a
NICE PRICE USA INC. having an address 3699 W. Henrietta Rd., Suite 15, Rochester, NY
14623 and LEONARD CARON having an address of 223 Peakview Dr., Rochester, NY 14467
the principal sum of One Hundred Thousand Six Hundred Sixty and 56/100 ($100,660.56)
Dollars, together with per diem interest of $17.68/day from May 24, 2011, until the entry of
judgment on September 19, 2011 (118 days) of $2,086.24, plus contractual attorneys’ fees and
expenses incurred by plaintiff in the amount of $5,791.23; making in all the sum of $108,538.03;
and that pursuant to the loan documents between the parties, this judgment shall accrue all
additional costs, fees and attorneys’ fees incurred by the plaintiff after entry of this judgment;
and that the plaintiff RBS Citizens, N.A. have execution therefor.
