                                     PLAINTIFF’S MOTION FOR ORDER TO SHOW CAUSE FOR
                                   ENTRY OF FINAL JUDGMENT OF MORTGAGE FORECLOSURE

                 COMES NOW, the Plaintiff, U.S. BANK NATIONAL ASSOCIATION, by and through its undersigned
        counsel, pursuant to Florida Statute §702.10(1), requests that this Honorable Court Order Defendants to show cause
        why the attached Final Judgment of Foreclosure should not be entered.   In support of the relief requested herein,
        Plaintiff states:

1         Plaintiff has properly filed a Verified Complaint against Defendants alleging a cause of action to
foreclose on real property.
         2.        Said Verified Complaint states that Plaintiff has the appropriate standing to foreclose, that the
borrowers have failed to make the required payment of principal and interest and that said failure to make such
payment constitutes a default on the underlying I      Note and Mortgage.
         3.        All conditions precedent to commencement and maintenance of this action have been performed,
satisfied or otherwise discharged.
         4         Section 702.10(1) Florida Statutes provides:
         A lienholder may request an order to show cause for the entry of final judgment in a foreclosure
         action... Upon filing, the court shall immediately review the request and the court file in chambers
         and without a hearing. If, upon examination of the court file, the court finds that the complaint is
         verified, complies with s. 702.015, and alleges a cause of action to foreclose on real property, the
         court shall promptly issue an order directed to the other parties named in the action to show cause
         why a final judgment of foreclosure should not be entered.

         5         In light of the foregoing, Plaintiff is entitled to the issuance of an Order to Show Cause as to why a
Final Judgment should not be entered against Defendants.
         6         Should this Honorable Court issue its Order to Show Cause, Plaintiff shall serve a copy of the
executed Order to Show Cause for Entry of Final Judgment as required by Florida Statute §702.10(1).
         7.        The proposed Order affords Defendants all of the rights and obligations as contemplated in Florida
Statutes §702.10(1).
