ORDER OF REFERRAL AND RECUSAL ON COURT’S OWN MOTION
Before the Court is GERARDO GERRY LOZANO’S (hereinafter
“CONTESTANT”) “Contestant’s Original Petition '
With Request For
Disclosure”. CONTESTANT sued DAVID WHITE (hereinafter
“CONTESTEE”), but have not secured service.
The Court reviewed the entire file and now finds it necessary to
recuse himself from this cause pursuant to -
the Election Code.
Accordingly, pursuant to Section 231.004 of the Texas Election Code, the
Court hereby refers this cause to the Honorable Missy MedaIy, Presiding
Judge of the Fifth Administrative Judicial Region for the assignment of a
special judge to preside in the contest and decide the issues of the
election contest Without a jury.
The Court ORDERS the ?Hidalgo County District Clerk to send a
certified copy of this Order and a copy of the “Contestant’s Original
Petition With Request For Disclosure” forthwith by email and by mail to
