MOTION IN LIMINE
Defendants, ELEGNIS TAMAYO and JOVANIS TAMAYO, by and through
undersigned attorneys, file this Motion in Limine and as grounds therefor would state as
follows:
1. The subject lawsuit arises out of a motor vehicle accident that occurred on
May 19, 2019. JESUS OLIVERA, and
The Plaintiff, his wife, DALIA OLIVERA, have
sued the Defendant, ELEGNIS TAMAYO, and the Defendant, JOVANIS TAMAYO,
seeking to recover compensatory damages. DALIA
Note, the claim of the Plaintiff,
OLIVERA, is a loss of consortium damages. Among the damages being sought by the

Plaintiff, OLIVERA, are past medical expenses and potentially
future medical
expenses allegedlyreasonablycertain to be incurred as a result ofthe subjectaccident.
2. JESUS OLIVERA, had
At the time of the subjectaccident the Plaintiff,
health insurance through Blue Cross Blue Shield of Florida. The Plaintiff,JESUS
OLIVERA, continues to have health insurance through Blue Cross Blue Shield of Florida.
3. The medical providers who have provided treatment JESUS
to the Plaintiff,
OLIVERA, post-accidenthave either been paid by Blue Cross Blue Shield of Florida or a
third party on its behalf or, in have elected to not submit their bills for
the alternative,
payment to health insurance but electingto treat under a letter of protection.
4. Pursuant to provisionsofFlorida Statute §768.0427 as amended March 2023,
the Defendants file this Motion in Limine requestingthat the Court limit the evidence
and/or recovery of past medical expenses to either what has been paid by health insurance
and/or what would have been billed if said bills had been submitted to health insurance.
Further,the Defendants seek to limit evidence on any claimed future medical expenses to
be limited to what the payments would be by health insurance for any such future medical
care or treatment.
5. The Defendants take the position that the provisions of Florida Statute
on the basis
§768.0427, while passed subsequentto the subjectaccident,applyretroactively
that the statutory provisions at issue are procedural in nature. Courts in other

(holding that provisionsof Florida Statute §768.0755 requiringplaintiff
to produce
evidence of defendant's actual or constructive knowledge to recovery in a premise liability
lawsuit is procedural as opposed to substantive);Litvin v. St. Lucie County Sheriff's
Department, 599 So.2d 1353, 1355 (Fla.1St DCA 1992),(findingthat statutory amendment
on a worker's compensation claim that there be an "actual knowledge" threshold for
recovery was procedural);Stuart Stein, P.A. v. Miller Industries, Inc.,564 So.2d 539,540
(Fla.4th DCA 1990) (modification of burden of proof on a claim for punitivedamages to
"clear and convincing" standard did not constitute a substantive change but was procedural
in nature and may be appliedretroactively);
Larocca v. State,289 So.3d 492, 493 (Fla.4th
DCA 2020),(statutecreatingDaubert as the standard upon which opiniontestimonyis to
be analyzedwas procedural in nature and should be appliedretroactively).
6. Undersigned counsel is of the understandingthat this Court has previously
addressed this issue and found that the provisionsof Florida Statute §768.0427 which are
procedural in nature shall be appliedretroactively
and further,that those provisionsas it
relates to admissible evidence on claims for past medical expenses and future medical
expenses is procedural in nature and shall be appliedretroactively.Attached hereto is an
Order which undersigned counsel believes this Court entered on this issue.
7. Any claims for past medical expenses or future medical expenses should be
limited to what was either paid by health insurance or what would have been paid by health
insurance if submitted.
